Is 8/3 wire with #10 ground okay to install oven?

I am swapping out a gas combo oven for an electric combo (240v) and will run an NM-B 8/3 wire about 70', The 8/3 cable I have has a smaller ground wire (#10) which I' don't recall seeing before. The oven specs state 30 amp minimum breaker. I have a 50 amp breaker on hand. Can I use the 50 amp, or do I need to get a 40 amp. And is the 8/3 wire okay to use, or do I need to get an 8/3 cable with all #8 wire?
