"Disconnect" definition (for a water heater)

Is a 240V switch (double pole) considered a "disconnect" according to NEC?

I have one on the water heater, but it hasn't been a code issue since the heater is within line of sight to the main panel. Now that I'm about to wall off that area as a utility room, I'm questioning the switch's validity as a disconnect according to the rulebook.

If it's not, what's the proper item to use? Do they sell single-breaker panels? I didn't see such a beast at the local BORG...
