6# or 8# wire- again

looked through earlier posts, and didn't quite find this question answered- I have an older, smaller hot tub that I'm about to hook back up. The tag on my unit calls for a 40amp circuit, which I have via 8/3 w/gnd travelling 18 feet to the gfci disconnect. Can I stay with 8# thhn to the tub? (only about an 8' run) Here's the other thing- can I use a 50amp gfci spa panel within this 40 amp circuit (the supply breaker would trip in the event of overload, right?) I ask this after finding the 50 amp boxes to be cheaper and easier to find

You probably need wet rated conductors if this is an outdoor installation. For any outside parts you need to use an insulated ground and NOT 8-3 cable with a ground bare in the sheath (the code does allow such for inside runs).

If the breaker in the main panel is 40A, then the 50A GFCI serves as a GFCI and an oversized disconnect (which you need anyhow within sight of the maintenance point on the tub).
