Taggie battle of 2003 to present

Anyone recall the threats after enticements from Marlene to make her a Taggie replica 2 years back? They are still using the ploy on another sewing/craft forum that you have to be a paid member of. My daughter has been aware of it for a few weeks now.............bringing us up to a FUNNY discovery.

We are in an area that has Hancock Fabric store. We were there recently & picked up a free brochure about using fleece & fleece gift items. Guess what??? Pictures & instructions to make a "Ribbons Of Comfort". Our take-along fleece blankets have small loops of ribbon stitched in the seams to provide babies with tacticle & visual stimulation.

People have had their listings pulled from e-bay recently because of Taggie's complaints, I mean with "proof" of Fisher Price having one out in the early 70s too. Wonder if Taggies will jail us for copying Hancock's directions? I still have never seen a true genuine Taggie. Remember, I got my directions from a phone conversation describing a homemade one to me by a non-sewer.

When I was required to respond to the allegations, I told them they needed to be getting their own fabric & ribbons that were not things available to the general public or they would never have their own item not being replicated.

I wonder what part of their profits go to their patent attorney? what they pay the ones who search online sites? the ones who attend craft shows, coast to coast, looking for them in booths? I guess that's why they have to charge $30 + s/h for something that can be made & shipped for way less than $5 each.

This will be interesting to follow & see what happens between Taggie & Hancock. Booklet says you can teach from the publication but you can't make copies w/o Hancock's permission.

I remember all that!! Sheesh, was it that long ago???

One of the founders of that company emailed me and tried to trick me into making one for her so that she could 'bust me' for copying her product. I wrote back and told her that I wouldn't charge any less than the (taggies) website she mentioned. She emailed me back about how she really really wanted one and would I make it for her. I said I was pretty busy and wasn't going to get to it very soon and why didn't she just order it from them and she gave me a bunch of rubbish about not wanting to "order online". That sounded pretty fishy to me, so I just deleted her emails and ignored her. Later we find out that she goes around to sewing forums, tricks people into making her a "blanket like the taggies blankets" and then threatens to sue people that make it and send it to her. Nasty woman.

Thanks for the link! I've got my copy printed out. (evil grin) Maybe the DOVE shelter needs a couple dozen of FREE ONES...LOL!

some people don't have enough to do. i mean really - it's such a simple idea and what kind of person sues people for comforting a baby!

Good grief.

I think that they need to have special fabric and ribbons printed with the copyright thingy on it - and leave the plain ones to the rest of us - and get a life!

I mostly lurk here, but Joan I remember your battle very well. My DGD was just born and in 2 more weeks she will be 2 years old.

She has a taggie, and loved it! LOL I don't think mine turned out exactly like the link, but she was happy with it, she held it thru her feedings and would sit in your lap for a long time just holding and feeling it.

Amazing this battle is still around! I didn't remember your story, ell. This world is full of troublemakers - y'all watch out!

I guess the babies know best, but I just didn't see what was the "big whoo" about these things. I would rather give a little one a stuffed doll or animal - or better yet, a quilt! Let them drag it around, I don't care. The best quilt I ever made was completely threadbare by the time the little girl was 3. She loved her quilt to death.

Wonder if you changed the shape of the thing and called it a "lovey blankie" if they could sue you?

Lord, I must have written novels on this thing. I still say it's a scam artist doing a number on everyone. I can't believe people are still letting the woman get away with this scam. El had the right idea...ignore the woman.

Joan sent me a copy of documentation which was the same badly photocopied letter unjustifiably threatening me for Hummels demanding money for being in violation of what I had never done--I even called the attorney listed on the letter long distance and never got a call back. Attorneys always call back and never send out badly done anything---I know, I worked for them so the letter was the first clue. I kept the letter until I weeded out what I really didn't need to avoid paying unnecessary poundage when I moved.

This was also a good lesson in having a backbone when I started receiving collection calls for accounts I never had--this is a current scam going around documented in my city's newspaper.

I received two collection letters and immediately noticed it was the same name, different company and address from the previous year's letter for a store (called store fraud unit to straightened it out because it wasn't me). I played along with the collection agency on the first phone call to get numbers and credit company names. The woman also said these nine accounts ..that's right, nine and hint no. 2...wouldn't come off my credit report for another 3 years and I know what is on my copies of credit reports from the 3 reporting agencies--that was hint number 3. I then proceeded to call every fraud unit for every credit card company, verified that it wasn't me, and gave them the head-up on what was going on. The gal from the collection agency called me back mad and nastier than all get out because several fraud units had called her back--I really enjoyed that one. The supposed attorney that didn't speak or present as an attorney called me a few weeks ago about the same accounts and then noticed I had called all the fraud units...he hung up quick when I mentioned it and hasn't called back since then.

These are all nicely done collection letters with problems of the same writer's name, different company and location, and a slicker operation. The woman running the sewing scam could learn some lessons from these guys...heh heh heh.

I got a return msg from the lawyer mentioned in my letter after I sent certified letters to him & Taggie's hdqtrs. I did not get a response from Taggie's until I complained to the lawyer a couple of times. It was basically noncommittial. Each issue I pointed out was commented on with "we will consider this".

Frankly I would have ignored the whole thing after the first phone call and letter and saved myself a lot of postage expense and time. You can almost bet that after each we will consider this, they did nothing.

Apparently these people have found a new forum to scam. If this forum is smart, they will block the person from posting anything further.

I haven't heard from the scam collection people in the last few weeks. After what I did to them, I don't think they will be calling back any time soon.

Marlene just had my ebay account suspended for the same thing who is this lady what should I do I am so mad ebay is a part of my income and I made these blankets but called the Handmade Tag blankets not taggies. I want ebay to restate me, I had made 100.00 today and it is all gone because she got it suspended i do have her email address,

This sounds like the battle over the Laura Star like quilt where a lady got nailed on E-Bay because of her description of the quilt--basically she did it to herself for using the Laura Star name and the book she used. She did a rebid and changed the description.

I wonder if the woman would bother you if you described the blankets as a handmade baby's blanket with colorful "tabs" sewn on the blanket edges.

It is the term "tag" and any form of that word that may have caused the problem.

I would contact her and have a frank discussion about her suspending your e-bay account after discussing the situation with e-bay (be specific about what the woman pulls as a heads up to e-bay).

Inducing someone to make an item that "infringes" your purported rights, then suing them for soing so, is enough to get the suit thrown out of court.

Trademark and Patent and Fisher Price link?

I work with copyrighted materials ... and they say their ribbon designs are copyrighted (don't copy the designs onto ribbon of your own manufacture) and the fleece has a copyrighted design (again, if you manufacture fabric, don't copy the design).

What "Taggies" does have is a TRADEMARK, when applied to infants and children's goods ... look it up at uspto.gov ... and like any company with a trademark (such as Intel or IBM) they will defend it from being used by other people.

They also have a patent: 6,427,265

"An interactive security blanket for children comprises two fabric sheets sewn together to provide a blanket body. One of the sheets preferably has a colorful children's pattern or design, while the other is provided in a complimentary solid color. Additionally, a plurality of spaced-apart ribbon loops, or "tags," are attached to the four edges of the blanket body, and extend out therefrom. The lengths of ribbon comprising the tags are looped from and back into the seam between the pieces of fleece, and are firmly attached at that seam. The tags are provided in a variety of colors, patterns, and textures, e.g., they may be wide, thin, silky, textured, bright-colored, pastel, shiny, solid, and/or provided with fabric prints suitable for children. That could be invalidated by "prior art" from Fisher Price, but it's expensive to defend against a patent suit.

I would like to know what long-term studies have been done to prove the value of this particular item. My own child bored easily with many of the items produced by the major companies such as FP, and a "blankie" of any type was never of any interest. There was more interest in the tactile and visual stimulation provided by the "normal" objects. As a "top-o-the-class" student with scholarship offers to several top universities, I guess nothing was lost by not buying a "Taggie".

Also, I would never buy or make one of these because I can see the potential for injury should a baby's finger or toe be caught in a loop that becomes twisted. But, that's just me. ;-) bggs

Thank you for all your info. I have emailed her a 100 emails and she has not wrote me back at all I have informed ebay about the situation. I feel that she is a scam artist. She may have patient on the item but so does levis does that mean no one else can make jeans give me a break. This would never hold up in court. I didnt even use fleece when I made them I used a furry material on on side and a flannel on the other. I wanted to know the lady who got all the collection calls and falst attorny calls was this done by marlene. She is not even the one who started taggies.

from what I understand something like 60% of patents are overturned in court.

Someone just has to take her on.

And, remembering I'm not a lawyer, I would think if she "entices" people to make the items then tries to get money out of them that would be called "unclean hands" in the eyes of the law.

After all is said and done, I hope you got your e-bay account back.

I haven't heard from the collection agency (agency with an address that always changes, signed by the same person) I called the bank fraud unit about. The bank verified it wasn't me, called the collection agency and the collector called me back cussing, yelling, and swearing, very unprofessional. You have to love the company fraud units.

I did some research on the agency and it seems they are being sued by several states for their business practices. I looked at one rip-off site, there are scads of complaints about them, and entered just a few more about them.

Hmmmmmmmmm ... if I make something at the request of the copyright holder, it CAN NOT be infringment. They have an absolute right to authorize reproduction of the copyrighted work.

I did get my ebay site back, and she wrote me a letter from her attorney saying that if i said i wouldnt sell them anymore that they would not take further action. So I did I wish I had money and time I would take her to court.

Awbrey, did the attorney write you a letter directly or did she send you a copy of a letter from her attorney? Big difference there...and did it look like it was xeroxed a few times too many, basically badly done and unprofessional looking?

I would be a stinker, make a few blankets using the same materials and advertise them as baby blankets with wide "loops" which they are. About time we put those tube turners we all bought years ago to good use.

Well, isn't that kind of what a patent is all about? The reason hancock's can provide instructions and all, is under the assumption that a kindly-hearted Grandma will make these and give them to her grandchildren. I suspect you can GIVE away as many as you want. It's only when profit is involved that anyone get their "knickers in a twist."

Frankly, I don't have kids, but it would seem to me to be far more interesting to make and carry around a stuffed animal made of different textured and colored materials. Those little loops look like finger trapping objects to me, too.

Something is not right there...the attorney would have written you directly concerning the matter and billed her for the letter sent to you. You should not have received a copy of the attorney's letter unless she is photocopying those too.

The stuffed animals sound like a good idea and a good way to use up scraps from your other sewing projects.

Babies choose what they choose without logical explanation because they like the object. Put one thing in front of a baby, they will grab it; put something different and they may grab or turn their nose up at it.

OK, maybe this isn't the place to do this, but after reading this, I'm determined to NOT buy a "taggie". Yesterday I was looking for ribbon/loop security blankets on eBay, and had 5 saved in myEbay. Today....gone. I'm looking for a blanket, from 16x16 to 20x20. If possible, I'd like fleece on one side and satin/silky material on the back. I'd also like a "girlie" blanket--pink and/or purple. I'm a stay at home mom, so I don't have a ton of money to spend (yet another reason to not buy a "taggie"). People are pretty gun-shy any more about anyone looking for help in making anything that resembles these blankets because of past instances that started this whole thing.

This would be a good time for you to learn to sew or do other crafting.

I just had 2 of my auctions on Ebay pulled by none other than Marlene. So I was thrilled to find this posting.

Turns out that after emailing Marlene a couple of times yesterday, I finally got a emailed signed by Julie Dix. Not that it gave me any additional info, but at least it was a contact.

She sent me a link to their patent. I want to know what idiot in the patent office gave them such a broad patent to sew fabric and ribbons together. Seems really ridiculous to me. These Taggies people are nasty! I, for one will be telling all my family and friends never to purchase anything from them.

I have been trying to figure out how to circumvent their patent, but because it is such a broad description, really can't come up with anything.

Also, if anyone has a link to a picture of that Fisher Price blanket from the 1970's, I would love to see it.

The last two posters need to seek legal advice...I don't think this is the forum to do it.

As far as the Fischer Price blanket, you can go to the patent site at US gov. and do a search for Fischer Price blanket...you should come up with something plus prior patent numbers for reference. Then see an attorney specializing in the field.

Taggie inc. will get what they deserve. What comes around goes around karma can be a nasty thing. If I was marlena I would be carfull there are some crazy people out there. Im just happy im not in her shoes, there have been lots of peoples ebay terminated because of her, lots of people use ebay as a source of income. It is very sad that she cant just write people and ask them to take it off before she goes off and suspends their ebay, I feel sorry for this lady one day she will mess with the wrong person.

I am not so glad to see others with the Taggie dilemma. I have had my listings pulled and my account suspended because of the Taggie Nazi's! I have been making these blankets for years and made them before I knew Taggies existed! GGGGGRRRRR! It just goes to prove that you can patent anything if you have the money to do so. Patenting a baby blanket!!! If you wanted you could patent the idea of placing cheese between 2 pieces of bread and calling it a 'Betty'. Then no one, under penalty of law could make a Betty without your permission! Sorry...had to vent

My pencil shop is now open again... The eBay gods have looked favorably on me and reinstated my account. I better get back to the sewing machine. I've got a store to refill with something other than my special taggie blankets :o( No worries they will get what is coming to them.

I remember back when all this started.
I just went to Ebay and typed in ribbon blanket. A whole lot of these blankets came up, by different sellers.
Are these just ones that haven't been turned in yet?
I would imagine some of them are just regular people trying to make a few extra $$ and probably have no idea the hoo-rah going on over these blankets.

Wrong. The VERO program is relying on the DMCA, and if the person who brings the complaint does not follow the rules, EXPLICITLY, including filing a lawsuit in a federal court within X days, the person against whom the complaint was issued can ask for a reinstatement.

lazygradens- My bad... and after alot of digging in eBays policies I found the information. Thanks, it makes me feel better to know that someone with a grudge can't just start reporting you for infringement on things that don't even belong to them. Call me paranoid... But all in all, if you are a SAHM using eBay as a sorce of income, any downtime is distressing and waiting for reinstatement is tortureous. I'm glad that I didn't fall into that catagory but it was still unnerving experience.

It isnt like you are reinstated the next day the process takes along time, people who use ebay as a source of incom cant do anything to about a week or so after they go in and say they wont sell them anymore, Its sad that taggies are so hard up for money that they have to go and pull some poor moms listing for 15.00, taggie inc. never sent me an email or anything asking me to take off the item, I had no idea that I was doing anything wrong. Me to when 2015 rolls around I will sell as many as I can, and I will get all my friend to sell them as well. Lazygardens is pretty upset about the whole thing does she work for taggies??????

I just did a quick search on Ebay for "ribbon blanket"
There were 30 items that came up, about 8 of them are listed as "New Authentic Taggie" blankets....so does that mean that all the others that are the same design, with the ribbons, are in violation?
The 8 or so 'authentic' ones are listed by seller moocowmeadows.
Wish I still had my kids Fisher Price one.

jenni ca, I re-read Taggies patent abstract etc last night. The patent is SOOOOO broad that it covers sewing ribbon together to form a loop and sewing between 2 pieces of fabric anywhere on the blanket. That means (I believe) you can't sew them into patchwork and sell it for commercial gain. It also covers alternate shapes of fabric with tags sewn into them. Sew (tee hee), all of the not 'authentic' taggies posted, even if you don't call them Taggies are in violation of patent laws. If they have Taggie listed anywhere in the auction they are also in violation of trademark laws...someone correct me if I'm wrong. It also appears that their first patent was granted in 2000 (not 1995 like I originally thought) and I think they are good for 20 years.


ihatetaggies marlene, It seems as though someone would have thought to patent the 'hamburger', but I don't think there is one. The only thing you can't do is open a resterant and call it McDonalds, even if all you do is make sandwiches. You'd be in violation of their trademark. As much as it really sucks that Taggies is being SO obnoxious about the whole thing (and believe me it infuriates me to no end) some dork in the patent office granted it. If I win the lottery tonight, I'll spend the money to challange their patent ok! Then we can all make them. Until someone challenges the patent, we're stuck.

lazygardens, If the fisher price blanket was patented in the 70's their patent would have run out in the 90's. How much alteration would the Taggies co have to make to the patent to make the idea repatentable (??). If they didn't have to alter it at all then making a reproduction of the original would then be in violation of the Taggies version, correct??? This is all pointless if the original can't be found as I have searched the patent office's website endlessly for the fisher price version.

I remember that about 30 years ago I had dog who loved to nibble on the tag that came on blankets (Do not remove under penalty of law) I thought at the time I should make her a blanket with tabs sticking out all over it. So I had the idea 30 years ago.

List your ribbon blanket one ebay like this

I think everybody should go to the good will and buy a stuff animal for .25 cents and when they list their handmade ribbon blankets they should list it as stuff bear bonus free handmade ribbon blanket. That way no one is breaking any patent laws.

Off the subject of Taggies & to McDonald's. There was a guy here in Oxford, Alabama whose name was Donald & he had a resturant named Mr.Donald's & was in no way like McDonald's fast food or menu. McDonald's learned of him & sued him & he had to change the name & really closed it soon after. He thought they didn't have a leg to stand on since that was his legal name & he was open before McDonald's. It broke him to fight it. They claim was it looked enough like their trademarked name that it COULD confuse people. Most McDonalds were on city streets & his was outside town on a state highway which became a ghost area after interstates opened & fast food places swamp the exit areas. Don't really know if it was loss of traffic or the law suit that closed him. I think law suit because there is still a food place in the building. I don't think Taggies has the clout of McDs but you never know.

I just called Hancock Fabrics and they no longer send out the "Ribbons Of Comfort" instruction sheet...because, and I quote, "we have had too many reports of the blankets being unsafe because of the ribbons cutting off little fingers circulation...mothers keep putting them in with their babies while they sleep and we do not want children to lose any fingers because of us." So...needless to say no one can get this instruction sheet anymore. I don't know if this is why they pulled them or not, but this is what they told me. Anyone having one of these instruction sheets...maybe you could give me a copy or duplicate of one. Thanks!

Well, I just got a letter from attorney yesterday regarding my "Tag Alongs" via email.

I'm wondering if I can change them by sewing the loops on teh outside of the back of the fabric, sewing them together and then topstitching the loops up? Seems to be the sewing loops between 2 pieces of fabric. This wouldn't be sewing them between. Don't know if that would work or not but might see how it looks.

I have a friend who had a "Taggie" for her son. When i had my daughter I thought how cute Ill try and find her one. I was appauled at the price of these things. Two pieces of fleece and some ribbon, shame on these women for taking advantage of consumers. When I tried to research how to make a "taggie" i found this forum. This is ridiculous, I will be darned if my baby doesnt have one of these because of a couple sue-crazy, greedy women.

Since this "design" is patented (I wonder if I could patent breathing?), you probably won't find directions on how to make it anywhere on the net.

However, I did find directions on how to make a pillow with prairie points (triangles of folded fabric) sticking out from around the edge of the pillow.

To adapt this to your needs, I offer the following observations:

You don't have to use prairie points.

You don't have to stuff the pillow.

You can top stitch around the edge of your unstuffed pillow.

We had a McDonalds' hamburger joint in our town....started business in the 1930's by....you guessed it....John McDonald!!! Mickey D's sued John's son and grandson out of business about 10 years ago!!! What are the courts and judges thinking????????? I just hope the old rule of "what goes around comes around" still holds true!

This is the first time I have been to this forum.I go to Hosta Forum and Embroidery forum a lot AND I have been making tBaby "things and selling them for a long time.........I was totally unaware of all this controvery...we even wrote a poem to go with this "thing" so new moms or grammas would know what it was all about.....am I in touble now....well at 74 a life sentence won,t be too long........and what about denim tote bags? who has a patent on them? and by the way, I love the forum! do any of you go to the Hosta Forum? Cutiekiz7, don't think that will happen any time soon.

It is so much easier and safer for babies to buy a piece of fleece and blanket binding, sew the blanket binding on all 4 sides to finish the ends, and call it a day. There are so many different blanket binding colors and prints put out by manufacturers these days to coordinate with fabrics.

Babies always did like to futz with the blanket binding, a much safer alternative in my view. If you look closely at those ribbon loops, babies can get their fingers caught in the loops and cause some serious injury to their fingers and no one knows how they manage to do it.

Hi. I've been reading these posts with interest. I made a couple of blankets with ribbons for my daughter, and I was looking around a couple of weeks ago for sewing patterns and found one for a ribbon ball. I thought I saved it to my computer, but now that I'm looking for it, it's gone. Plus I can't find the website with the pattern anymore. I'm thinking they got rid of it. I didn't know this issue with taggies had been going on for so long, but I swear the ball pattern was there a couple of weeks ago. Anyway, I know everyone is paranoid that someone asking for a pattern, or link to one, is going to be a setup, but I really would love to know if anyone knows of a link for the ball. I guess I could figure it out myself, but I'm a new sewer, and I'm wondering how you make something that would be round enough without an actual pattern. There's probably some math involved, but I was trying to avoid that. Anyway, I think the taggies pattern is invalid, and also noticed that it's a reissue patent, so I wonder what they had to change when it was reissued. It seems it's way too broad the way it's written (and I'm a patent agent).

I'm sorry if you were offened. There are several people on this board that Taggie's has threatened with a law suit. So it's serious business to us when someone new asks about this particular post and we've never seen a post from them before.
This board has been used to "set up" good intentioned people.

I'm sure that Hancock's removed the link because of Taggies. Anyhow, with all of that said welcome to the boards and we hope you stick around and get to know us. We really are a helpful bunch of people.

I've been reading the post on this taggie war. Yes I have posted on here just recently. I have posted on the craf forum also. I use to be a regular many years ago. When they started charging I didn't join because at the time money was very tight. I would read alot of the post and get alot of ideas to make Christmas presents. I really missed this forum and until recently hadn't been here.
I can understand where you would think that those of us who are new would be under supsion. I understand completely. My daugther bought some designs off ebay and thought they were on the up and up but come to fine out that wasn't the case. It costed her a little money and a lesson learned.
Susan I did send you a e-mail not realizing the date until after I sent it. It was concerning the big Spring sale in your area as my daugther lives in the Briginham area.

Hi! I just asked for the instructions, too. I'm a new mom who is interested in learning how to make tag blankets. My daughter adores her homemade tag blanket I won as a door prize at a Halloween party. She has a 12x12 flannel blanket she cuddles with at night. She also likes to sleep with it on her face, so I prefer not to have heavier (fleece) blankets for her. If you look me up on ebay, you'll see I've purchased some tag blankets recently. Hi everyone, I'm new here & no I'm not a Spy! LOL I'm a mom of 5 & I've been sewing for years now. I'm amazed that a company can have a patent on a baby blanket! Isn't there more than one type of car, doll, computer, ball, peice of paper??? How can they have the rights to something like this? I know that I'll continue to sell them locally, it's funny I've been selling them for a while now & only found out last year in July that there was an actual company with a patent. I guess great minds think alike! = )

There are a few scams running around on this thing, as I was on the receiving end of it for sharing Hummel patterns--I don't share and have all original purchased charts and kits. They ask for money, threaten, and never return phone calls or e-mails (save the e-mails so the isp address can be saved and tracked back when you report the scam to your isp).

If you can get a physical address for this person that is even better so you can report the scam to the postal service for mail fraud. If you get a letter from a Boston law firm that looks like it's been photocopied a gazillion times and not an original letter an attorney will send, it is a scam.

This is the kind of stuff that Clark Howard at clarkhoward.com could help you with. He's a consumer advocate on talk radio. There is no charge for what he does. These kinds of scams could ruin your credit and worse. If someone actually levels a lawsuit at you, you are required to answer it. That usually costs a fortune. Seems like there's a lot of funny business going around related to this issue, which may have nothing to do with the Taggie name. It may help to try to find the source of some of this stuff. Linda

Taggie returned my email and phone call - they sent copies of the patent and said if I didn't "stop making, selling and using" them their attorney would be contacting me. I wonder if they will sue my two little granddaughters that are 4 and 18 months if they don't stop "using" them!! I left pictures of them on my website and sorry, taggie won't let me sell them any more. I call mine tag-along security blankets, but their are dozens for sale on ebay that say taggie and are not made by taggie. Wonder why they are not being frozen??

I know that "Taggies" are having some problems with their "love notes"--they are being examined by the consumer protection agency because of numerous complaints about there pilling and dye running--I know becaus e I was contacted after I filed a complaint--I had bought 3 of these things for my daughter who adored them and the same thing happened each time; I had attempted to workwith Taggies and even purchased the last one from them but all I ever get is the run around--I was basically tld that i was an over protective mother and that there was nothing wrong with the blanket. All well and good EXCEPT that Chloe STILL was getting a mountful of fabric and dye all over her mouth! The only person that was even remotely pleasant and helpful at "corporate" was guy in customer service and, when I called back the Tuesday after memorial day i was told he was no longer there! I can't help but wonder if it was because he had too much integrity for Taggies? If they talk to people like the woman I spoke to talked to me then they will only be around a short time longer, let me tell you your average mom is NOT going to be treated like this!

In Salt Lake City, UT there is a an who works for a news station. His show is called Get Gephardt, on KUTV channel 2. (Unsure of spelling) He takes cases like this and broadcasts them. He might be able to get someones attention. (His show is a local channel on Dish Network in Utah and Idaho I don't know where else, but that is enough to maybe get someones attention. I have seen him take on many scam projects like this before. (And he has the funding) Just an idea for anyone who has letters and emails to prove this. Everyone on here with any kind of experience with this should contact him. I've included a link to the news website.

I hate to say this but I didn't know all this was going on until a lady at the fabric counter in Walmart mentioned it. I have been selling my loveys with ribbons on Ebay. Today I got a message through Ebay from a woman wanting three of a certain style. Once I gave her a quote I noticed the similarity of the name given "Maren" to "Marlene." Please advise....

I didn't read every post on this thread so forgive me if I am repeating something someone else has thought of. I too was concerned with the safety aspect of the "tags" so what about making the blanket safer and still have the tactile aspect of the taqs. Would sewing ribbon strips into the blanket edge without looping them be in violation of the patent held by Taggie Inc.? I'm sure a variety of ribbon materials could be found that would satisfy the textured aspect of the original can be found and various fabric types could be sewn into the edge also. Just sew a tube of fabric and attach it into the seam. This eliminates the "loop" that little fingers and toes can get caught in and still gives baby something to play with. You could even double the ribbon and sew the edges together before attaching to the blanket. You could also do different shapes of inserts to make it more interesting. Your blanket could end up looking entirely different from the patented version.

Has there been any follow up on this since last postings? I never knew this was such an issue.
I have been making baby security blankets, some w/tags, some w/o tags for awhile. I just started selling them on ebay and recieved an email notifying me that my item had been removed.
I'm not sure if this is beacuse I used the word 'taggie' in the description or if you just can't make items similar to tradmarked items. Does anyone the clarification on this. I can sell a similar item as long as I don't use the company name correct? Where is a good resource to uncode the patent laws?

I am also new and I found this thread by doing a search on Google for 'Taggie Blanket Instructions'. I have no ill intentions here or anything and I don't want to beat a dead horse. I just wanted to say that people are selling these type of blankets, etc on Etsy.com and there are at least 60 pages of them listed.

The bottom line is ebay can pull an auction on anything that is listed if someone says you are using copywright infringement. Calling it a Taggie or making it with "tags" would get the auction pulled.

Loganhogan is correct: using a copyrighted name or trademarked name on eBay can get the auction pulled.

In this case, not only is the name copyrighted and trademarked, but the DESIGN itself is PATENTED. Patents are a different issue entirely. No matter what you call it, you can't legally sell objects like it without violating patent law.

From the Wikipedia page about patents:

"A patent is not a right to practice or use the invention. Rather, a patent provides the right to exclude others from making, using, selling, offering for sale, or importing the patented invention for the term of the patent, usually 20 years from the filing date."

Somehow, someone managed to convince the US Patent Office that sewing a loop of ribbon into a seam was a NEW idea and a new invention. *I* dont' think it's a new invention, however, I don't work at the patent office, so my opinion doesn't count.

I believe a poster on this group reported that the patent holders informed her by letter from their lawyers that she could not allow her toddler to *use* a similar lovey blanket that she had sewn herself. And patent law does, indeed, give them the right to do so.

It's a crazy situation.

Thought I'd mention that today when I went in the local Food Max grocery store on the Paper towel isle they had an end cap of these things called Chcukie or Chickie or Chuckie or something like that, anyhow it was minky on one side, fleece on one and the "tags" were not loops like the taggies but looked like sewn straps for a totebag. They were solid pieces of fabric not ribbon, that had a crinkle sound to them like they were some form of rip stop nylon or polyester, anyhow they were about 7.00 each and I wondered how they got around the Taggie patent.

I would hate to see a baby get it's finger damaged in a blanket like that, but I would say it is a real possibility. And............if they do, I hope they sue the pants off the Taggie company. Just what they deserve.

While I sympathize with your position as a cottage industry, I have to admit that I also understand the other side, too. I design quilt patterns and it's extremely frustrating to find my designs being used without any credit given to me.

It's almost impossible to police such things, but since Taggies DOES have a legal patent, they are well within their rights to protect it. You have to keep in mind that it's not who invents or comes up with an idea that has the legal right to it, it's the person who has the patent or copyright for it. If you really want to get into a pickle, try selling something with a Disney character on it sometime! BTW--it's perfectly ok to copy these things for YOUR OWN USE, it's only when you try to sell them that you get into trouble.

Has there been any update on this issue? I just had many of my listings removed from my Etsy shop. Items I designed myself. I had never heard of the Taggies Corporation, nor seen a Taggie blanket. I just made some items using the knowledge learned from observing my babies fondness for ribbons and tags. I put a few looped ribbons on my cotton & minky blankets that were secured under blanket binding and a few on some soft toys I designed. This is way beyond ridiculous, has no one challenged these women after all this time? I have been making items like these for twenty years and thought I would list them on Etsy. Is there any new information?

I've never seen one of these, actually. I can visualize it and if am wondering how much you would have to change the design to not have a problem. The above poster says to simply not form a loop. But, what if you wanted loops? Could you, for instance, sew one side into the blanket and tack the other side down with buttons? Finish off the end of the ribbon in a V shape and sew it to the blanket using a button or some other decorative notion. You still have loops but the design has been changed. Would this be enough to allow you to sell them?
