can social security be denied?

a neighbor is on social security disability.payments started in late 2002. in late 2004 he started working as a security guard for the minimum hourly wage. he never reported his job to the Social security administration.

last week he received a letter which he is suppose to fill out and send back to the adminstration.it stated that his wages for 2004 are not reported. it also went on to say that to keep receiving disability checks would depend on the answers he gave.he made over $11,000 last year. this year he is working less hours.

what is he up against? yes, a big corporation. but does anyone know what his future might be? he's a diabetic. but not sure if he would be considered disabled now.

i told him not to worry. he's 63. he can still draw social security. he worked over 30 years for the same company.

later. i got to thinking. was i wrong to tell him that he can still draw because of his work record?

it's a right to draw social security isn't it?

although he'd be drawing less at this age than he would if he waited until he's 65. but the way its looking. he might have to. what do you folks think? any suggestions/info?

any inside information that i can help him with?

Your neighbor's biggest problem to sort out at the moment is the potential for a criminal charge of fraud and theft of public money. I think he needs a lawyer to broker a settlement. My guess is that he can make a structured payback of the money and still collect social security though it will be less than what he has been collecting for disability.

When applying for DISABILITY benefits, you agree to report income from work or self-employment and/or a medical improvement in your condition. Your friend may not have fully understood this when he first applied. However, since your friend is over age 62, he MAY be eligible for RETIREMENT (not Disability) benefits. These benefits would be reduced for age since your friend is younger than full retirement age. Have him ask Social Security for more information. If he is indeed overpaid, he has several options- pay back the full amount in one lump sum, spread out the debt by monthly refunds, or file for Reconsideration or Waiver. "Reconsideration" means he disagrees with the facts of the overpayment. If he wants to have the overpayment waived (forgiven), he will have to prove that 1. he did not cause the overpayment AND 2. that it will cause him financial hardship to pay it back. Again, contact Social Security. Visit your local office in person or call 1-800-772-1213 for information and/or an appointment.

rosalynd, SS is a "pay as you go system". That means that the money taken out of your paycheck every week is spent to fund THOSE ALREADY RECEIVING SS checks every month. You seem to be operating under the misinformed belief that whatever money you are presently required to pay into the system is somehow being earmarked for YOU at a future point in time. It's not. When you retire and are eligible to collect SS benefits it will the younger working population's tax contributions that will fund your checks. And there's the rub... there is a large population "bubble" of retirees hitting 62-65 and that means a LOSS of people contributing weekly and an increase in the number of people withdrawing benefits! SS was originally set up as an INSURANCE policy against a catastrophe like the Great Deperssion; never was it ever intended to solely fund someone's retirement. But over the years, a large segement of the population has presumed just that. It was designed to be part of a "three legged stool"... SS, pensions from worker's companies, and personal SAVINGS. Additionally, the age of retirement set at the inception of the system (65, I believe) was actually beyond the average age of death of most Americans. My parents withdrew every dime they'd contributed to the system within 18 months of receiving their first check! Mum is now nearly 80, so she's been on the dole for nigh on 15 years now. Roll forward to 2006... companies are defaulting on defined pension plans, the age of retirement has been increased only a bit (is many years below the average age of death; about 15 years for me!), and the average American doesn't SAVE a dime. The IRA was introduced to stimulate retirement savings... the contribution one may make has increased from $2K at its inception to nearly $4500 now. Additionally, they've sweetened the pot for lower earners by permitting you to pay taxes "up front" (presumably when you are earning less and paying less), allowing the nut to grow and compound TAX-FREE until you decide to withdraw funds from it. In light of the loss of company pension plans this is a nice deal... but only for the disciplined. Taken in total, this is an impending disaster. The "cures" are not going to be popular, but they are necessary. Let's hope more politians find the stomach to stand up and state "the emperor isn't wearing any clothes". Payroll taxes will HAVE to go up. The retirement age MUST be raised to more closely reflect increased life spans, and (I believe) we will have to means test. The very wealthy will have to say good bye to their "cut" for the greater good. After all, that's how an INSURANCE policy works, more people with "safe" histories pay to cover the losses of unluckier policy holders. This isn't something for the courts, this is something for the voting booth.

Anyway, the ability to withdraw, repay and re-apply has been taken away. Once you actually apply, you are more or less locked into your benefits. Jannie, it has not been taken away entirely. I learned from the video that there is still a 12 month window where you can "change your mind". I verified that from the SS.gov site which states: ..... " Recent change in the withdrawal rules.Effective December 8, 2010, you can only withdraw your application for retirement benefits within 12 months of your first month of entitlement and you are limited to one withdrawal per lifetime." Wildchild, I am glad you (& others) found the video so helpful. Not everyone will take the time to view it, to their possible detriment. I also looked @ the AARP website (as Franklin recommended) & they have an excellent current article with really good examples. I haven't looked to see what they might have in the way of archived articles. Chisue, I so agree with you that the argument for a *voluntary* SS-like system kind of flies in the face of how little $ soooo many people save towards retirement. I do understand that it is nearly impossible for some given their low wages. But as an example, one gal I worked with participated in the company's voluntary retirement savings plan... to the tune of $5 per month. No kidding!!!! She had no kids & was an educated woman... but obviously clueless as to how ineffective that amount was. She actually "threw money away" since the company would have matched her contributions to a much greater amount!

"I really hate how the government creates such havoc in people's lives!" Just thank your lucky stars there is even such an agency as Social Security to provide those who really need it with some sort of meager retirement income. I doubt it will be around long enough for our children and grandchildren to benefit from this program. Yes, it's bureaucratic and complicated to deal with but it sure as heck beats the alternative......which is nothing!!

chisue, FICA tax was designed to pay for social security benefits and it's been overcharging for that purpose since it started. Also, remember that self employed people (as I was) pay double the amount, currently 15.2%. It's a heavy tax and more isn't needed. alisande, economically it's a free country. There's a (maybe inadequate) safety net for those who falter or fare less well than others, but isn't each individual alone responsible for their lot in life and to take care of themselves and any others they support? I won't go along with any Robin Hood sentiment, those who obey the law and work hard to do well are entitled to their rewards. Those who don't strive and try anything possible to improve their own financial adequacy or well-being will do poorly and are entitled to those consequences too. There should be far more programs to help people redirect their lives and learn market-demanded job skills but beyond that, hmmm.

can he go to just any Social Security Office?
I know there are complaints about some SS Offices.
I went with a friend who was unable to drive and she was treated bad in my opinion.
But I went with another friend who could not drive and she was treated nice.
A neighbor retired last year and she was so mad at the attitude of the SS Office she said she would never go there again. Wish I had asked her if she had to or could go to another office. She just turned 65 and 4 mo. Her retirement age.

Anyone can go to any SS office they like. Every office services a certain "area" based on zip codes. However,they are open to the public and cannot send anyone away simply because it is not their "home area" office. If you had a bad experience at one particular office, it may have been the fault of one cranky person. Maybe the person you dealt with was simply having a bad day. Hard to say. But if you feel uneasy at an office , it is your personal decision to try another.

When I took retirement I did everything over the phone with Soc Sec They told me what documents to send in etc. That was in Florida

I don't think that regular social security payments can be denied, but they can be withheld to pay off money owned to the Government. In this case, he may owe some sort of penalty and fine, with interest.

"Disability" implies that he can't find a job that he can handle.

The Social Security meaning of "Disability" means that someone has a medical (physical or mental) problem that prevents him/him from performing work activities for a period of at least a year or is expected to end in death. Level of education, age, work history, and availability of jobs are given some consideration.
