Is a wood a deck right up against a house a problem?

I have a tenant who built a backyard wood deck touching the brick of my house all along the back edge of my house without my permission in Brooklyn, NY. The deck is just a few inches off the ground. I don't live there and just found out. Wouldn't this present a fire hazard with this wood being right up against the house? His gas grill on the wood deck is. I was told it needs to be 10 feet or more away from anything combustible. Wouldn't this also damage the foundation as moisture could collect under it and damage the brick and or foundation.

There was also no permit obtained, which I was told by law there should have been. I'm having it taken down if this is going to damage my house.

Would appreicate any feedback on this as I know nothing about decks. Thanks!
