Height at which you need a porch railing?

We have an old Victorian and we're restoring the front porch. I've seen some front porches that just have columns but no railing. How close to the ground does the porch have to be to not require a railing, as per insurance companies? My husband seems to think we will be required to put on a tall railing like a new home rather than have none or a shorter one, like the original on the porch.
