Town Inspection Failed and Whose Responsibility

I have hired a contractor to replacing the handrail and landing of the emergency exit of the staircase. The contractor said that in addition to replace all the rotten woods, the old support for the landing is not good enough. He needs to build foundation with poured concrete. However he did not pull a permit and told me that it is fixing the existing, no structure change, therefore no need for a permit. Somehow the town found out and asked to apply permit. I am okay to apply for the permit myself with $50. My question is what if the inspector came and found out the work is not up to the code. Is it the contractor's responsibility to rework or I have to pay extra for the work. What if the contractor do not want to work on it? oh, the contractor said he has the license.
