Town Inspection Failed and Whose Responsibility

I have hired a contractor to replacing the handrail and landing of the emergency exit of the staircase. The contractor said that in addition to replace all the rotten woods, the old support for the landing is not good enough. He needs to build foundation with poured concrete. However he did not pull a permit and told me that it is fixing the existing, no structure change, therefore no need for a permit. Somehow the town found out and asked to apply permit. I am okay to apply for the permit myself with $50. My question is what if the inspector came and found out the work is not up to the code. Is it the contractor's responsibility to rework or I have to pay extra for the work. What if the contractor do not want to work on it? oh, the contractor said he has the license. he either outright lied to you ... or he is oblivious to local code ..

either way.. i wouldnt let him in my house...

let alone contemplate ... whether he will do the job properly ... nor show up.. when you find the job improperly done ... and c all him to make good on his job ...

ps: i am surprised.. it isnt in your written contract.. that he will apply for and secure all requisite paperwork

His contract was very simple and I had to add a few details such as the type of wood to use and etc.

If I hire another contractor, it would be another $3000 for the rework. The previous one just got away with what he left out. Should he be held accountable?
