Legal question re: our pool build

We are having a dispute with our PB. He decided without our consent to use a grout color that looks horrible with our pool tile. Luckily they have agreed to pay for the tile and reinstall.

The problem is we decided we wanted to add more pool tile. We wanted to carry the tile down to all the steps versus just one and to tile the Caribbean shelf on the deep end as well. We understand we would have to pay for the tile but now our PB is saying we have to pay $27.00 for them to install and that doesn't include the tile! When all said and done it will be over $55.00 per SF. That's insane. He is saying if we use our own tile installer, they won't warranty the pool for any cracks etc w gunite, which has nothing to do with a few feet of tile instal.

I know he is trying to make up for the loss of the tile, but that was his fault. We asked on multiple times to meet with us to the over the tile, which were ignored. He choose our grout color and now he is pissed at us for his own mistake.

Can they legally not warranty the entire pool if we get our own tile person just to tile a small section? I can understand then not warrantying the pool tile, but the whole pool???

It's frustrating. We went with a big pool company and so far we have been happy with the quality of work and with everything but our project manager who is seriously checked out.
