Others here will probably know more about this, but I think a buyer has recourse through Paypal if the listing misrepresented the item. I hope you're not stuck with these!

Have you contacted the seller? What was the seller's rating?

Perhaps you would be able to return the items. Failing that, open a dispute through eBay, and you might get some satisfaction.

Open a significantly not as described claim. This gives the seller the chance to offer a refund. If they don't, escalate the case. Ebay will likely force them to refund. You will be told to ship them back to the seller and do this with delivery confirmation. Signature required for anything over $250. Shipping back will likely be at your own expense, unless the seller agrees which I doubt she will. Once you have your refund, then and only then should you cancel the transaction that the seller will send you that will get the seller back her ebay fees.

If sellers have cases open against them, they lose some of their ebay benefits. You gave the seller a chance to refund when you wrote to the seller in the first place. She could have told you to return for a full refund if she wanted to avoid the case.

Keep all of your ebay messages so ebay can read them.

Agree with the above. If they were advertised as actual Snuggie brand but are not and are only similar, ask for a refund. You may or may not be stuck with the return shipping, not every seller is the same.

File a 'not as described' claim with Ebay if the seller doesn't make good on the sale to your satisfaction.

And, I really have gotten some too good to be true purchases on Ebay...that really were good. I had a year where I couldn't afford to pay close to full price for clothing, household goods, many things - not one seller disappointed me or misrepresented their merchandise.

Is this the seller linked below? If so, the listing sure seems deceptive to me.

It is in the As Seen on TV category, which would lead me to believe it was the real deal and not home made.

I buy & sell on Ebay all the time. I'd return them the cheapest, slowest way possible, just keep the receit from the post office. File your claim with Ebay and Paypal..."Not as described". Advise in your detailed report you contacted the seller and they are not willing to refund your money, the product was returned. In 30 days or less, Paypal will refund your money. :0)

I agree with the suggestion of opening a claim. I've done it because the $225 item I bought was not authentic as it claimed. In your case, she can't call it a Snuggie if it is not an original, authentic Snuggie (which is probably a licensed name).

I'm 99.9% you will win through Ebay/PayPal and get all your money back. Good luck.

Chemocurl, the linked seller has a 99.8% rating (although she claims 100%), so it's probably not the seller under discussion. But that link is interesting because she calls the product a Snuggie and gives the manufacturer as YSO. Apparently someone (I'm guessing the original manufacturer of Snuggies) lodged a lawsuit against YSO. Here's a link to the legalese.

chemocurl, that is exactly the one!! Thanks for all your help. I contacted the seller again, but with no response. I will give them a couple of days to respond. Chemocurl, it does not say in the advertisement, snuggie type, or anything like that it says snuggie. Very deceptive..I appreciate your help, I have bought over 401 things from ebay since 1997, (know that is not alot) and this is only the second time I have been ripped off, but this time it was for more money than I can afford. The other time was for some cologne that was never sent, but it was only $5.00 and the seller quit selling before I could even email them that I did not get the cologne, so I did not do anything about it. This time it was for much more. Do not have money to just hand out to people for false advertisement.

I saw where I had purchased two, on another advertisement on his link (where you go and see what else he has for sale, has more of the same thing), and then that same day had ordered another one. He has a 100% feedback and says he intends to keep it that way so I am wondering what happened? Why? I was really nice when I wrote telling him that my snuggie did not have tags like he advertised and seemed to have missed stitching around the sleeves on two and the stitches where not caught in some places in the fleece in some place on the hems. I told him I knew things like this happened at times and could he please help me...blah, blah..being as nice as I could. That is when he told me that they were just snuggie type.

Someone left them a negative review, with no comments, on Dec 1st on the Snuggie blanket....I imagine that is what dropped their review rating to 98.5.

In light of the lawsuit against YSO, I think it is comparable to trying to sell fake Rolex Watches or anything else that is 'fake' on Ebay.

I wonder what Ebay would think if they knew about the lawsuit and the seller listing the manufacturer as YSO. hmmmm....I'd let them know.

I would be mad too... but I think some may think the term snuggie can be used for any fleece sleeved blanket... kind of like how kleenex is used for tissue.

I think what happens on ebay a lot is... It's hard to describe or sell any generic of a product without using the brand term... I don't think they allow the term "like" or "replica" to be used in descriptions. So, if you're searching for anything that isn't named brand, it is very hard to find a cheaper generic without being able to use the brand term. It's very frustrating because you may want to find a generic and don't know how to search for it. With that being said, it doesn't make it right what they are doing but they did list the correct manufacturer.

I noticed they do allow returns and they didn't charge for outgoing shipping...so even without filing a dispute, you should be able to return the items for a full refund and only pay the return shipping fee. I know you shouldn't be out that but thought I would mention it.

If you are looking for real Snuggies... Amazon has some, and I'd try other stores instead of ebay. The price on them has gone down tremedously since they first came out and you can usually find them really cheap.

EBay has a history of being strict about stuff like that, though. Once I tried to put "shabby chic" in a subject line, and got reprimanded by eBay. I had no idea it was a proprietary term.

You only have 45 days from the date of purchase to file a claim. Don't let that date pass.

Thistle, the Snuggies online store has the purple for $9.99 - so does Target, individually boxed and ready for gift giving.

I don't know if any of your recipients are men, and if they would snuggle into purple - my DH does like and wear it, a long time UW fan :) It's not an odd color on a man in Washington at all...

Carla35, you mentioned that ebay would not allow like or replica, but I was looking at the amish heaters and they have some that they advertise as amish style, but others say just amish heaters. If I were wanting to buy an amish heater I would be wary of amish style heater that is advertised, and go with an amish heater that was advertised. When I saw the advertisement for these snuggies it no where mentioned that it was a snuggie style blanket. It said it was a snuggie. That is why I bought it. Also it said with Tags. There are no Tags at all. I have gotten over the mad, just disappointed.

Thanks for the information morz8. At this point I have already spent the money for these fake snuggies and I know it will take forever to get this resolved..probably after Christmas. I was wanting them for some really nice neighbors, but I do not have the extra money to spend. I guess my neighbors will have to do with the regular little pound cakes, and candy I make. Plus some were going to some of our extended family. I had done some alterations and sewing to earn some extra money for this but that is o.k. It will work itself out I am sure. Hopefully it won't take forever!

I'm sorry this is a disappointing experience for you, but if I were happily your neighbor, I'd be thrilled with your pound cake and candy, made with your own hands.

I consider Ebay a total gamble. You can get great stuff, or you can be ripped off. I consider anything I buy and I'm happy with a "good deal". If I'm not happy, read the fine print and you'll probably see the seller said "No refunds or exhanges" , something like that.

This ad looks deceptive to me too. Why not let Ebay decide?

I assume you paid with Paypal, so I'm not quite sure why you haven't filed a dispute.

I once failed to receive an item, filed a dispute and 10 days later Paypal refunded me everything including the shipping charges. Paypal is extremely protective of the buyer - if there is any dispute they will investigate and settle quickly.

It's hard to explain what I mean... I guess what I am getting at is if you were the seller how would you describe your generic snuggie without using the term snuggie? Your item would never come up in searches because people put in the term "snuggie" even to search for generic versions. Ebay really needs to account for a system where people can search for replicas or "like" models of things by keying in the brand. It's hard for a seller to list anything if it is not a brand name... if an item is only known by that brand name. Again, not saying what they did is right, I just think that's why they did it.

By new with tags... it doesn't necessarily mean with tags hanging. Many new clothes don't have tags. It generally just means new. Here's ebay's decription: "New with tags: A brand-new, unused, and unworn item (including handmade items) in the original packaging (such as the original box or bag) and/or with the original tags attached.

New without tags generally implies they had tags or packaging that was removed. Usually a sweater you never wore. It generally implies the item was bought and not used.

The "tag" word is confusing but IMHO the descriptions are really used more to imply exactly how new the item is. I don't think they meant to deceive you with it.

By the way, I know I mention they allow returns but I have both a snuggie and a generic version. They are both cheap material. Snuggie's themselves are not known for their great quality. You can probably find some reviews. I think that's why they are so very cheap now. I know you paid for the brand name and want that but if you were really hoping just for a sleeve blanket, I wouldn't doubt the quality of your fakes is just as good as the originals.

You need to contact ebay ASAP. eBay does not allow the sale of replicas. The seller violated an eBay policy.

I did contact ebay and paypal last nite. I thought it over and over, I really respect several of your advice and expertise on this I went ahead and filed a complaint. Especially since you saw the ad also. Thanks so much. I wanted a snuggie. I wanted my family and neighbors to get a snuggie, and not a knock off version. It said a snuggie, so I was counting on a true snuggie not a knock off version. Thanks for your help. I hated to do this to this seller, but maybe he will change his wording and it will prevent some other buyer from being disappointed.

I didn't receive an Avon skin-care item I bought thru Ebay. So I contacted the seller- she said "I"ll look for the mailing receipt" then heard nothing. I filed a protest with Ebay/paypal, they said it was too small a purchase for them to get involved. So I was out six or eight dollars. So long ago, i don't recall the details. I'm sure $255 isn't "too small" I hope you get your refund.
