Are Wood Flooring Installation Instructions just "guidelines"?

In a bit of a situation with crackling, popping, noisy wood floors that were not installed on a proper thickness of a subfloor for the joist spacing. Builder says that NWFA has installation "guidelines" only, not requirements. Okay, but the wood floor manufacturer installation instructions follow the NWFA guidelines for joist spacing and subfloor thickness. Are the manufacturer's instructions only guidelines as well? My builder is arguing that our floors are safe, structurally sound, just noisy and that different people have different sensitivity to noises. Well, our hallway sounds like firecrackers going off during the middle of the night when someone walks down the hallway. Good for warding off intruders, but not for a restful night's sleep. We are fighting this and want to make sure that instructions are instructions, not guidelines. Does anyone know? We've already had a floor inspection done. Getting ready for a fight.
