Small gap between hardwood: Normal or Problem?

Our house is coming up on its 1 year punch list review with the builder.

We noticed that our 3.5" Red Oak hardwood in a couple areas is not as 'tight' as the rest of the house.

In other words, the wood panels/board plank have small gaps between each other maybe 1/8" at most - more like 1/16" on average.

From all I know, wood was acclimatized & installed last Feb/March 2013 & the heat was on according to the thermostat history log.

Another note is that we noticed the floor is creaking noticeably more than last year.
But subfloor was glued & screw to the joist so we think this creaking has something to do with the gap above.

Is this wood being wood in winter? or a serious issue beyond that?
