check received for deceased relative

My relative passed away last fall. I was her executor--but, there were no assets beyond her bank account, $500 which went toward her funeral. (I paid the rest of the funeral expenses and her personal possessions had already been disposed of when she went into the nursing home). Since there were no assets I did not have to open probate. Her bank account is closed.

Now I have received a modest check for her, part of a class action settlement.

What can I do with this check? If it is at all possible to cash it as her executor, how do I go about it?

I would ask my attorney, but his bill for the phone call will be about double the size of the check!

Is it one of those checks sent out under the seal of the SEC? I'd be tempted to go to your own bank with any executor documents, POAs, etc. even though they may be dated or expired. Your bank may just take it for deposit in your account. Worth a try.

Jeri, the west coast is not all the same all over. You may not have blackspot problems in your area but a lot of gardeners from Oregon and Washington state did and do report serious blackspot problems. Kate, I do support your wish (or your SIL Âs wish) to stay away from Knockouts for various reasons. Did you check out Lynette's website and check on her experience with hybrid teas? She is in British Columbia so her climate might be (but not necessarily) similar to Oregon. In any case she does add comments to her photos about blackspot and which roses are 'good beginners roses' in her opinion. Maybe a gift certificate to Pickering or Palatine is a better idea in case her soil is acidic and would give you (that is, to her) more for the same amount of money. Grafted roses will grow much faster and will give her pleasure already in the first year. Pickering has old roses, Chinas, Bourbons and a lot of moderns, some of them marked as disease resistant. As to for reds, I could recommend Papa Meilland, Royal William (aka Duftzauber aka Fragrant Charm) and Barkarole (if you can find it). Many people on the forum praise Firefighter but I do not grow that one. Prospero and The Prince are pretty good among the Austins and WS2000 also, if she is willing to spray a little bit. I have an own root Sophie's rose from Chamblee's after one year now it starts dong well but own root Austins are slow to establish in my experience. (I ordered, among others, Tradescant from Pickering- I do hope I will not regret it.) It is great to shop roses as a present but also a big headache, so I wish good luck to you. Thanks for all your advice I know a lot of it was scams he really believed the nigerian scam-i have a lot of fake money orders and checks to show for it-i didn't know any of this was going on-he gave me credit cards to purchase things for him and I don't recall what the card was-which bank-to be honest I really didn't pay it much attention-so i feel that he is the one that opened these accounts but again he would answer ever junk email and pop up on the computer even scanned his drivers license and ss card in and sent it to these people-i don't know it is frustrating that he would do these things but I know that he thought that he would be helping my mother he really believed that these people were legit-he was always sending money western union to somewhere-I have asked the callers to send me the information and as yet no mail most all of the accounts were opened within the last 8 weeks of his life-he died suddenly of a heart attack I don't know what he had been doing I just can't handle this stress any more-i have sent copies of death certificate, will poa and all other information that would prove to them his death-they know that can't come after me as I am not responsible-they threaten to sue the estate-what estate there isn't one-i spoke to an attorney and was advised about the same as you guys-tell them not to call-send letters which i have done-maybe i should just change my phone number then they will have to send me mail-i don't know sorry for the long rant-i just can't describe what i feel, frustration, pity anger and love for my daddy that I know he would never do this in his right mind anyway thanks again and i will let you know how things turn out you guys are too kind

So the contractor we were working with used only Mid-Continent Cabinets. After working with him since early June to put together a plan, he just told us yesterday he won't be able to start our kitchen until at least January. My husband is a contractor (works in commercial and medical development) questioned the breakdown of $25,000 for pretty standard cabinets which we think bugged the GC. I have $15,000 in Bosch appliances sitting in a warehouse and an engineer's plan for a beam to take out a wall. We are frustrated and disappointed. My husband is now considering coordinating our reno himself. Any suggestions on to pursue cabinet work - we our outside Orlando, FL...

Olychick, since when is expecting adult children to check on an elderly parent such a burden to the children? When were they at one time not a "burden" to the parent, too? For many, many years! In fact, no mother on earth ever quits worrying about her children, regardless of their age. I am speechless. I'm not talking about coming daily to give meds or baths or other personal care (although I have had many friends who did do this for a parent in the past). A daily check-in phone call will take far less time than these same adult children undoubtedly spend on social media. It's a very strange world to me where children feel they should be relieved of all responsibility for an aging parent short of putting them in a home or hiring outside help. I am quite capable of taking my many meds, bathing myself and getting dressed. I also pay my bills - nothing wrong with my brain at all. But it would be nice to be checked on regularly to be sure I'm okay. Frankly, I'm far less worried about falling and dying than I am about how long it might be before it's realized I'm MIA and someone needs to check...for the sake of my TWO DOGS!

Thank you both. Hilltop, those links were just what I needed! Duluth, no seal -- this was a class action actually against my own bank!

I will contact the settlement firm to see if they will reissue the check to her estate.

I just went through this last week. My DH was part of a mortgage class action lawsuit. A settlement check came for him, so I took it to the bank, wrote 'for deposit only' on the back and deposited it - no problem.

Kay, had you had a joint account with him? I wonder why it was okay?

I had closed this relative's account months ago, so there would have to be some reason for me to be able to deposit into my account.

After my friends husband died she eventually changed phone servers. When she received a deposit refund check she could not cash it because he made the deposit on the phone and it was made out to him. They would not change it to her name. Finally one of the bank tellers told to just deposit it and see if would go through and it did. Who was going to complain?

Take the check and a copy of the Death Certificate and legal papers naming you executor to the bank. They will allow you to cash it yourself. (I'm no legal expert but I worked for Social Security for many years and we often dealt with uncashed SS checks.)
