Bankruptcy 15+ yrs ago..now collection agency calling?

| Okay bankruptcy excuted 15+ years ago. We have recently been getting calls from a collection agency (just started mind you) stating we have a past due account with a credit card and owe $3K back from 1990. This of course is almost all interest, etc. We checked our records and this credit card is not on our list (we only had a couple credit cards at that time, so we are really sure of our records). We have a VERY common last name, and my husband has a VERY common first name. SO I'm thinking this is a case of mistaken identity. Any way I can work on this? I've sent a letter to the collection agency stating I need proof this is OUR debt (I gave them NO information other than what they've given us so they cannot add any information on to the info they already have). Any other suggestions.

| Vickey, when you say this credit card is not on your list, do you mean that you never had this particular credit card? Or, did you have the credit card and not put it on the list, perhaps in error? Also, did you know to contact all the credit card agencies when your bankruptcy was over to get the bankruptcy off of your credit card reports? |

| We are 99.9% positive we did not have this credit card 15 years ago is a long time to remember, but I don't remember having any open cards that we did NOT file on, and at that we only had a couple of credit cards period. Yes we've seen our credit reports since then, this card in question has not been on them. Vickey-MN |

| It doesn't matter if you owed the debt and it was not on your list. They CANNOT try to collect it after 15 years. Just a couple of months ago a jeweller hired a collection agency to attempt to extort over $3,000 (2/3 of it was interest) from us for a debt we don't remember incurring 16 years ago! We have Prepaid Legal and all it took was an attorney writing a letter to the collection agency explaining that the debt was too old to collect. And we got a really nice letter saying that we would never hear from them again. But I'll bet a lot of people fall for those things. Find an attorney who will write such a letter for you. Even if he charges you a couple of hundred to write the letter, it will be worth it to get these people off your back. |

| Contact your state Attorney General for help. Many years ago my parents got a letter from a collection agency demanding money. My Dad wanted to pay, but thankfully my Mom refused. She demanded a copy of the bill and could prove it was not him (Dad), The agency told her they sent letters to all the people with that name, just to get the bill paid off. She then reported this to the Calif State attorney general for further investigation. |

| Fifteen years is a bit long. Most loan contracts expire at fifteen years. I agree that it could be mistaken ID or just a collector wanting exta. Just tell them they have the wrong person. I did this very thing a few months ago when a collection agency called me and in no uncertain terms told me I owed $3900.00 to a bank I never heard of since 1987. Yeah right! I told him he had the wrong person. Of course he got very rude. I hung up. Never heard from them again. Nothing is showing on my credit report. Sometimes I think they are trying to scare you or intimidate you so you will fork over some cash. |

| I had a similar thing done to me, last year I recieved a collection agency bill for an electricity account from a rural town I have never lived in nor for that matter ever visited. I was in a panic thinking someone was using my identity and sent an email off to tell them. Got the reply back that they had sent the letter to everyone they could find with the same name! I wonder how many people actually paid that bill, worried that it would reflect on their credit rating. Demand proof, they have to have all the relevant details stored somewhere. |

| Tell them 'statute of limitations is over. quit calling me.' By law they have to obey. Never, ever, ever admit the debt is or might be yours. If they keep calling, report them to the atty general. |

| I am a professional debt collector, been doing it for years. I have called on practically every kind of account possible. In stat and past, I just don't like how people think just becuase the debt is older than a couple of years, they don't have to pay it. If a friend lent money, would it be null and void to pay them back after a certain time? These places extend credit to you, you get the stuff, and then years after claim to have no recollection, how conveniant. I am not saying in your case it is your debt, just an observation of what i deal with day to day. If any one has collection ?s feel free to ask, I know all the tricks and things to get them to stop calling you. My mother says I should write a book. |

| had same thing happen to me. did a eb search , send a letter requesting not to be called, never heard from them agian. this is a scam where companies buy old debt from 10- 15 years ago for pennies on the dollar and try to rip people off. if its past statue of limitations, which in many states is 7 years, just send them a do not ever call me letter. also make sure you do a web search for the company that is sending you the letter. never call, never offer to send money. |
