If anyone can give me some info it would be appreciated. My daughter was living with someone and they have a mortgage on a home together, but she is not on the deed of the property. She is in the process of moving out. What if anything can we do if he refuses to refinance or put the house up for sell. They have only lived their for about 7 months. Thanks in advance to anyone that can give me some information,

She's on the mortgage but not the deed? Is that correct? Was there a special reason for that? I think we need more info.

We definitely need more information.

I lived with one boyfriend who had a major problem holding onto a job. Boring, lil' ol' me had a credit rating and the utilities were in my name. Mercifully, the landlord failed to uphold his end of the lease agreement and I was able to "break" it... rental agreement was in my name, too. I learned my lesson. And I was LUCKY my trusting nature didn't cost me more that it did. But I learned my lesson.

The helpmeet and I kept our finances scrupulously seperated until we married. Now, we are equally "on the stick", and that's fine; I flatly refused to have a joint checking account until we were married. We each paid our half of the utilities until we were married... two checks from two different accounts!

Until you are married in the eyes of the LAW I would counsel anyone sharing accomodations to have it SPELLED OUT LEGALLY. It is my own opinion that your daughter ought to see an attorney, ASAP. And she ought to keep her mouth shut around the boyfriend until she does.

I honestly don't remember where those 2 little trees came from - it is 2 3-prong trees in 1 pot... HD has never really been one of my haunts (none in the neighborhood until just a couple of years ago), so probably they came from Fred Meyer (our "local" W coast grocery/dept chain, AKA Kroger), the Grocery Outlet, or an actual locally-owned nursery or hardware store, but I've had them for years & couldn't tell you their current availability....and according to Nancy & my googling of the image, they're different than what are currently being called "candelabras," in that they are straight, not curled back on themselves. If you were feeling brave, or picked up a couple of plants on the cheap, maybe you could probably achieve the look at home by cutting out the growth tip of a single-stem plant & pinching off all the back-buds you didn't want? Just guessing, as I've never pruned a Dracaena before! I'm still mystified how they get the new growth going so perfectly spaced & close to the top of where the tip was cut out! Nancy, thanks for sharing pictures! Those are just funky looking little trees & I agree with you: I can't imagine them growing into anything but a snarled glob in a few years! But, I suppose many people don't keep their plants for that long anyhow, to address the original topic of the post ;) Toni, I cross my non-heart-shaped marginata to fertilize only *very* lightly for at LEAST the next 6 weeks, then move up to lightly & maybe, after re-potting, move up to 1/2 strength for a couple of weeks before top pruning.

susanfnp, were you financially supported by your parents when and during the time you were in school and living together? Were they OK with that? During the year we lived together before graduating, we were supported in part by our parents and also by scholarships, student loans, and 15-20 hour/week jobs. We did not ask our parents' blessing before we lived together and it frankly didn't occur to us to do that -- not because we didn't love and respect them but because they had always trusted, even encouraged, us to make our own decisions. Their support (financial and otherwise) was not offered or withheld in proportion to the amount of control they were willing to give us over our own lives. If we made bad decisions, we knew there would be consequences, but those consequences would not include losing our parents' love and support. And the fact is, I think we made pretty responsible decisions and our parents respected us for that. Our house (which we shared with several other students until we graduated) was not a den of iniquity. We were good students. We paid the rent on time. We got good professional jobs right out of school and were able to buy a house (without our parents' help) when we were 23. Most importantly, our parents saw that we each had someone we cherished and who cherished us, who made us light up, who inspired us to want to be kind, generous, and engaged in the world around us. What's not to be OK with about that? Our oldest child is now 19 and a freshman in college. We will pay 100% of his education expenses and give him a room/board allowance until he graduates; the only condition is that he remain in school (because if he is not in school he will be able to work and support himself, right?). He is free to choose where he lives, and with whom. We expect that he may make choices that are different from what we would choose for him (and has in fact done a little of that already), but he knows he is responsible for the consequences of his decisions, and making mistakes and learning from them is part of how one becomes an adult. We don't have any problem giving him advice or saying "we think that's a mistake", even when he doesn't ask us for our opinion , but I cannot imagine anything he could do that would make us withdraw our love and support of him.

Rose.....keeping you in my thoughts and prayers. Life is difficult at times. In 1994 both my kids called within a week of each other to tell me they were moving far away. DD was moving to Oahu and DS was moving to Tokyo. They left within a month of each other. It was so hard but knowing I had raised them to be independent adults helped. My son moved back to NYC in 2000 and DD moved back to California the year before. Then DS and wife moved back to Tokyo. We recently got together in Oahu for a week. It was so good to see him and to meet our granddaughter for the first time. Seeing DDIL again made me appreciate her even more. My grandson, whom I hadn't seen for a year, was a delight and we had so much fun. They are moving back to NYC within the next month or two. I am happy for me but sad for DDIL who has family in Japan but will be far away from both families in NYC. Life is filled with challenges and facing them will make us stronger, even though it is painful to endure. Look for the rainbow thru your tears.

thewifee, I feel your pain. I have been through much of the same with my DH and his adult SD (27 years old). SD always asking for loans and then spending the money on non necessity items like taking airplane trips and fun. I do blame it on my enabling DH. I believe he feels that the way to show love is to buy it from his children and the SK expect DH to give them money for what ever. Now I can see helping adult SKs out when they are in a financial bind but not when they spend the loan money on non-necessity items. All adults need to learn how to manage finances and I don't think some parents have prepared their children very well on how to do that. To theotherside, How would you feel if your adult SS uses 1500 of 2100 minutes leaving only the remainder of 600 minutes for DH and myself? In my eyes it is wrong and adult SS should get his own account and learn to pay for his excessive calling habits. I bet if he had to pay the bill his calls would go to non peak times and decrease in amount. But DH insists he continues to pay for adult SS (in college) excessive cell phone bill. I feel DH is just enabling his children to be losers and not responsable for themselves. What more he short changes us as a married couple so his children can have money for non-necessities and fun. Many times I get the short end of the stick because I then pick up the tab for us as a married couple. I get very frustrated. Does anyone have good ideas to stop DH from enabling his adult children to be dependent on us for money?

In reply to your questions. I diffently agree she should not have done this, it was so stupid. She has had some major financial problems and the utility company would not turn on the utilities with her name on the deed. I can't even figure out how they got the mortgage with her name being involved. The above explanation is what I am being told, but he has also been a very controlling individual so it could have been a lie on his part. Thanks for the responses I did get.

EEK! just thought of this!

Maybe your daughter ought to leave a few things there... I'm thinking that a complete removal of her things and a complete evacuation might be seen as "abandonning" a property she is legally required to pay for.

Get her to a lawyer and do it soon.

I really hope you will keep us informed about this. It's an unpleasant situation, but one that is probably too common. Your follow up could prove very helpful to more people than you might suspect.

I hope everything works out OK; you must be worried sick.

Are you absolutely positive that her name is on the mortgage? I can't imagine that she would be able to qualify for a mortgage if her credit was so bad that the electric company wouldn't turn on the utilities.

I went to the court house and pulled up the mortgage and her name is on it. I sure don't understand how she was able to be on it with her credit also. I would have thought he would have had better luck without her rating. I will have her contact an attorney to make sure of her rights. When she gets things settled I will come back and give you the out come. If anyone is thinking about entering into a situation of this type, Please stop and think hard on it before going ahead. Once again thank you for the responsed I have received.

Would you have told her that if she decided to marry this guy? Buying a house with someone I would say is no worse that getting married to someone.

I should know. It happened to me.

I live with someone who I bought a house with. Yes both of our names are on the mortgage. We had been together 9 years (in the house for 3). We hit a rough patch, and I was considering moving and selling the home. He could have made it difficult. He probably wouldn't quit claim the house to me (which might be a good idea for your daughter to do).

After getting some legal advice, I was told that I could prove that I put the down payment and made payments (I WROTE the checks) and then anything after that, the profit would be split.

But we worked it out.

Does she have any investment into this house? Have her get legal advice. It couldn't hurt.

How long was she with this guy? Maybe by all accounts they thought they would be fine. No one knows what the future holds. When people get married, no one goes into it expecting to get divorced. If she was married to him, and wanted a divorce legal counsel would be needed. So don't be too hard on her. Go to a lawyer with her.

If she's on the mortgage, but not the deed...does that mean she's legally responsible for the payment, but has no rights to the house? Needs a lawyer, yesterday.

You saw that she's on the mortgage, but did you confirm she's not on the deed?

Both DH and I are on the mortgage and the deed for our home. Yet every day one or the other of us gets junk mail regarding refinancing, etc in one name or the other. Even some property records come up with DH's name only, even tho the home is jointly (legally) owned.

Maybe the other party is trying to pull the wool over your eyes? DEFINITELY see a lawyer.

i have never heard of being on the mortgage but not the deed. i know it can be the other way, as my wife is on the deeds for our house and her fathers house, yet is not listed on either mortgage. she was required to sign the deed of trust so that if i defaulted the mortgage co could take the house, although i hope that never happens!

i agree with the others, GET A LAWYER NOW. even if they stay together there needs to be some sound legal documents involved before something happens.
