Family member divorced..ex having truck she cosigned be reposessed. When they divorced she sold her house and put money into cd at bank. If they go for and get a judgement is there anyway she can save her money. She owned the house 5 yrs. before he came along.

Lives in Texas..If she puts the money into an IRA can they still take it. She kept the vehicle with bigger payment but due to old child support issues the guy couldn't keep up with the pickup. She has about 25 from sale of her house. Has no retirement accounts at all, just the house money and she's 45. Thanks

I would think that she would be liable for the remaining amount owed on the truck. Maybe she could talk to the bank and explain that she is now divorced and she does not have the truck.

I'm left wondering if maybe she could just let them reposses the truck, and then she pay it off and then sell the truck to recoup her money.

Do you mean keep it, like in not have to use it to pay for the truck or what?
Or do you mean, she sold the house and can she keep all the proceeds?

I'd think such things as that would be covered in the divorce papers. She should have made the judge aware that the truck he was being allowed to keep, had your name on the loan. It is likely he would not have been able to keep it and ruin her credit by not paying for it.

If they go for and get a judgement is there anyway she can save her money.
Are you saying the divorce has not been finalized yet? Such things as the house, any equity growth in the five years, vehicles, loans, credit card that are owed money, should all be hashed out when things are finalized.

If the bank repossesses the truck, they'll have some substantial cost associated with the respossession and won't be under much presssure to sell it for top dollar that might be available.

As she co-signed, they can almost surely come after her for the difference.

If such a path may be available, it would likely be best from her point of view if her ex- can sell the truck, if he can be convinced to do it, as there'll likely be a larger amount to pay the bank (bank won't have all of those repossession-associated costs).

Leaving less for her to ante up.

If he can be convinced to be a nice guy: either way, he loses the truck. There'd be a concern, also, if he might be willing to sell the truck for peanuts. Or keep all of the proceeds of sale ... in which case, she'd be stuck with paying the bank the whole amount left owing!

Had she kept the house, if she couldn't have come up with the money, she'd likely have had to sell it - but in some jurisdictions, the carrier of a non-collateralized loan can't force a home owner to sell the home in order to pay them.

Good wishes to the lady for being able to negotiate a reasonable result.

Try to avoid getting the various people involved mad: indulging one's self when faced by such temptations can be (usually turns out to be) costly in the long run!

People roll into my shop almost every day with a super looking, shiny Chinese made scooter that most often is just weeks old if that. When I ask about warranty or possibly some support from the seller I hear pretty much the same story...he's no help, doesn't seem interested or they only sell them and some far away mystery outfit is supposed to take care of the problem. I completely stopped taking this stuff in even though the engines at a glance look like standard fair. What I have found is the starter recoil units are so poorly made they could never work for long. Valve train parts are complete joke though some do interchange with the engine they stole the design from. Dive into a carb and the main jet will twist off with the slightest turn of a screwdriver. At that point I have broken the mans part and look toward MAKING a jet to get me out of this mess. I could go on and on but there is little need. Don't try to get your 250.00 worth out of this machine. Your chances are so slim its unbelievable. Do I have any ideas for you to get 800.00 worth of good for 250.00....of course not. mike merritt

Yes, the company can sue you at anytime and will win, because you legitimately owe the money. When they win, they get a judgement against you and they can use that to put a lien on any other assets you have (house), clean out your bank accounts, or garnish your wages. You do want to settle with them before the court date, because after they've got a judgement you no longer have any leverage. But they usually take a while to get around to suing you, opting for collections agents harassing you first. Next time you talk to them, ask them what the deficit is (the difference between the $12K you owe and what they sold it for at auction). That's what they can sue you for and win. So there's the deficit balance, and then there are all sorts of "garbage" fees that they will have added on. Don't make baby payments at this point, as they'll just get swallowed up in the extra fees they keep adding, and it could be never ending. What you want to work out is a settlement where it's defined in time and amount. The best way to do this is as a lump sum. You save up 25-30% of the amount they say you owe, and offer it to them as settlement in full for the debt. Don't give them anything until you have it in writing that they'll take that amount as settlement in full. And don't give them a bank account number, as they'll electronically clean it out. Mail them a cashier's check or money order after you have the written settlement agreement. Until you have the money saved up to settle, don't have long conversations with them. Tell them "I don't have any money, I'll call you when I do" and hang up. But don't stick your head in the sand. It won't make it go away. You don't need a lawyer, you can do this yourself. And in the meantime, until you have a full time job, go make some income on your own. Clean houses, mow lawns, deliver pizza.

guvnah- Great link! It shows how "broke" the system really is in Texas. Some buyers and sellers want to hide the sales prices due to property tax issues which have become a huge burden in Texas. They should stand up to the local and state governments for more reasonable spending and taxation. The problem is I don't see that happening anytime soon with local school districts building 80 million dollar sports complexes with jumbotrons, etc. They are sellng massive bonds to build mega high schools, and aquiring a huge debt load. Realtors have long controlled prices, almost to the point of price fixing, with resticted and massaged sales numbers in MLS. If a house sold for $200,000, the public area of MLS will give a range of sold range of the house as 200,000 to 275,000. What good is that? Another pet peave is Days on Market(DOM)reporting on MLS. If a property was on the market for 180 days and the current listing contract expires, the current agent or a new agent can re-list it with a new contract and possibly a lower sales price, there by aquiring a new MLS number and start the DOM clock back to 1. I have seen properties that have been on the market for over a year have a DOM as recently listed and under 30 days! Sure you can go to a realtor to get that info, but why should you? Appraisals and market pricing, in Texas, have always been controlled by realtors. They control what is reported in and out of MLS. They will tell you that it is the market, ie, buyers and sellers that set the price, but in its the realtors that that actually "set" market price by telling buyers and sellers what price they should offer and sell at. I believe that if Texas had full disclosure that all values, after a settling period, would reflect the "true market". Home owners and sellers would have to stop voting for massive bond and debt loads and hold the local and state officials accoutable for responsible spending. Realtors/MLS sould be required to run an "open" book for listings and sales. This is the only way to provide the information required for accurate appraisals. Then its up to the appraisers to use their training and experience to provide their opinion.

Vacations and $2k on family pictures? Well then that is entirely different story all together. Growing up, my family (sadly) never went on vacation and the only time we had family portraits done is when we would get those "freebie" 8x10 certificates for Olan Mills. LOL! You know, where they say "free setting and 8x10" then they try to get you to buy a big package. My momma always took the free 8x10 and thanked them for their time and effort. justnotmartha, the grandparents do not have a clue...or else I am fairly certain they would start sending actual gifts as opposed to gift cards. I no longer have contact with BM's family, but did at one time, and the impression they would give me was always that they thought she was a piece of trash who cared more about herself than her children. (I never joined in and agreed with them...I just listened...I'm waaay to smart to stick my foot in my mouth like that!) I'm sure they would have a lot to say if they knew she was taking their gift cards. Vivian, still, if it hasn't or doesn't become a common thing, I would think this is something that could be spoken of in only a positive manner. "You helped out your family! How commendable and helpful of you!" Unless it became common, I wouldn't join in on any negative talk about the matter at all...that could feed hostility about the situation when it could be made out as a positive thing on SD's part...hopefully it was a one time situation...because if it wasn't/isn't I would definitely voice my opinion on the matter myself.

What does her lawyer say? She needs to get good legal advice, from someone in her jurisdiction.

Best she not try to do something less than honorable, on her own--that could end up backfiring and costing her a lot more in the long run.

I would think that if the house was hers before they were together, then it would still be hers now (or the proceeds of it), but depending on whether he ended up on the mortgage, or local laws, it may be different.

Only if the husband never made any payments on the mortgage. Otherwise he could claim half of the increase in value from the time of the marriage until the divorce.
I hope she's getting competent legal advice.

When she became a co signer she said I will pay the bill if he doesn't.
