Excessive gas usage/bill in rental - is landlord responsible?!

This is a long story, so let me summarize with several points: 1) As tenant, IÂm responsible for propane gas (used for heat, hot water, cooking). 2) Since IÂve never lived in Massachusetts, I checked with gas supplier about gas usage before renting the small house in July. 3) Based on their records to previous tenants, gas guys said 11-1200 gallons/year for this house. This is acceptable to me, so I rented the house. 4) Gas supplierÂs policy is to have new customers fill up the tank, so I filled 450 gallons on July 1. 5) On Nov 28 the gas oven wouldnÂt work, and landlord discovered that the gas tank was completely empty Â shock horror! 6) Another 425 gallons had to be delivered. 7) Gas guys later said there was a tiny leak, but that could only cause 50 gallons to leak out Â not HUNDREDS of gallons. 8) By posting to internet forums and using "gas calculators", I should only have used 350 gallons from July ÂDec. (Even this figure is more than fair because IÂm very frugal in my energy consumption Â thermostat at 66F Â winter has been mild, etc.) 9) Both gas supplier and landlord agree that the usage is WAY way way too much, but they canÂt figure out the reason.

So now I am in this desperate situation: Gas supplier says I owe them $1,800. I am happy to pay them $800 (i.e. 350 gal), which is my fair share. (Again, this figure is according to the gas supplierÂs experience and past records. IÂm not trying to take advantage of anyone.) But itÂs just not fair that I have to pay for gas which I honestly DID NOT USE! Why should I have to fork out an extra $1,000!

Landlord seems a reasonable person and he has been informed of this situation all along. He realizes that it is his responsibility to take care of furnaces, appliances, etc. But he doesnÂt think that he has been negligent, and so he shouldnÂt have to pay for the disappeared (and disappearing) gas!!

Even as I type, gas (and MY $$$) are flying out into space! That really turns my stomach upside down! Am I held 100% responsible for this gigantic gas bill since the lease says the tenant pays for utilities? Is there any way the landlord can be held responsible too? Please help!!

What do we know here? We know the fuel supplier charged you for 450 gallons of propane when you moved in. I am assuming that you have proof there really was 450 gallons there (is there a gauge you can look at?). We know that by the end of November, there was no propane left. We know they delivered 425 more gallons (again, assuming this amount can be verified).

What no one knows is how much propane you actually used. Agnostic Internet "gas calculators" are good for estimating, but they cannot reproduce your situation exactly and should not be used as a guide to your "fair share." After all, you've gone five months (or so) on 450 gallons, which is in keeping with the previous estimate of 1100-1200 gallons per year.

The propane company has no way of telling you how your heating, hot water, and cooking habits differ from that of the previous tenants. Your landlord likely does not have an idea of how much (or how little propane) you use, either. All anyone knows for sure is that 450 gallons have left the tank since July.

I would suggest the following: ask your landlord to pay to have the system checked by a qualified technician -- tank/valves, furnace/boiler, and water heater. He agrees that the usage sounds high, so he should be willing to at least see if there is a problem that is bleeding off the propane.

If there is, see if the landlord will cover at least part of the amount lost as his responsibility for maintaining the system. Whatever is left, however, is yours. You may walk around your house in a snowsuit, take cold showers, and only eat uncooked food. But no one has a way to verify that. And the numbers you've presented here are not that far off from where they "should" be.

If the $1,800 is more than you can physically pay at this point, sit down with the propane supplier and try to work out a payment plan. You also can ask in your city or county if there are any programs which will assist people who need help making fuel payments.

My propane tank is actually owned by the fuel company. We had a leak once that I reported due to the smell. They came and checked it and said it was just "venting" and proceded to fill the tank. The next day, the tank was empty again. It turns out a valve was faulty and sent the proprane streaming out once filled. Anyway, they ate the cost of the leaked propane. Have you noticed any propane odors or smells? I'd say you are on par with using 1100-1200 gallons a year with a 450 gallon usage.

OK, well two weeks late on rent is not horrible. I wouldn't beat yourself up over it. But I wouldn't get comfortable with it either. If you can come up with the full rent plus late fee, it's far better to get things juggled around so that you're back on track & rent is always on time again. And saving yourself that late fee, depending on how much it is, would pay part or all of a phone or water bill, buy a tank of gas, etc. Those late fees add up so you're actually paying higher rent. It probably sounds like goofy advice, but if push comes to shove, pay a smaller bill late one month (but only one month) so you can get back on track. Like the phone or water bill. They won't shut your water or phone off if only one month late. Keep a roof over your heads first, let all else come second. Then when back on track it would put you in a better negotiating position. As for the trash recepticles. There's 4 cans and 1 recycling bin. The LL said it's everyone's job to take it down to the curb and up again. The more I read the less I like about this situation and here's why (and it's just my impression, please don't take it as gospel). First, you've got a genuinely disruptive situation with a neighbor upstairs and your LL tosses out threat of eviction if you two don't quit quibbling. It's just not cool to threaten to yank someone out of their house unless there are genuine, serious lease infractions that can be proved in court. I don't know for sure because I'm not there and don't see/know all the facts, but it almost sounds like bullying on his part. Get on track with your rent, continue to abide by your lease, and don't let yourself be bullied. You have rights here as well. If he says it's "everyone's" responsibility to take care of the trash - perfect. So we can also interpret that your LL never said, or wrote down, that your father is responsible for taking other unit's trash to the curb. So tell Dad to knock if off. I know it sounds trite, but this girl is running all over you guys and she knows it. Stand up for yourselves! Get together with unit #3 that also complained if you can, let them know you're taking out your garbage and nothing more. Ask if they will take out theirs, and let that girl in #2 deal with consequences of not managing her own mess. Honestly, it just comes across like your LL treating you all like kids on a playground. Yes, everyone needs to get along. But it goes a lot deeper than that. We're not talking about play time and everyone gets to go home when it's over. We're talking about the place that you eat and sleep and call home, and you've got a right to some peace and quiet. And you are not your neighbor's slave and do not have to do garbage detail for them. As for damages, We've done none nor Violated our lease.. ... (I heard from an applicant once that they lost the house they were in because owner gambled her own + rent money away, so rental house + her own home were repossessed because she failed to pay mortgage and taxes.) Or he could be responsible and he's gotten walloped by the system. Maybe he's got properties financed and mortgage hit balloon period and payments went sky high. Or (as happened in our County) the way property taxes were assessed underwent major restructuring. Some areas of the County property taxes quadrupled. It was like a punch in the gut for everyone who owned any kind of real estate because of stupidity and local gov't saying "oops, our bad". A lot of people lost their own homes over it, and this was several years back when economy was booming. We have several properties and the taxes went so high instead of paying 2 installments per year I was paying 4, and that went on for 3 years. Still, I made sure I budgeted so I had enough to pay taxes, insurance and repairs expenses plus extra if something big happened like a roof replacement, but during that time none of it went in our pockets. There just wasn't any left. (Plus, like every LL in the County, I had to raise rents to cover that tax mess or we would have gone belly up. So renters were impacted in my area as well. Everyone suffered.) I guess what I'm saying is anything is possible. But a responsible LL will budget his $, make sure there is enough for expenses/repairs, and charge rents accordingly to cover all that. It's no secret how many properties your LL owns (it will be on record with your County and is public info, accessible online at your County's site or via Assessor or Recorder's office.) But please don't assume that if he owns multiple properties he's rolling in dough. I can assure you, I get that a lot and it just ain't necessarily so. Still, it matters with respect to the laws and what is required of him to keep your home safe and habitable, so that's what we'll stay focused on. ;-) So if you can elaborate on conditions you're living in, that would help.

Let me get this straight. You're looking up laws and planning to move because your landlord is maintaining the structure and premises??? Please read this. Maybe you'll see things from a more realistic perspective. Trees need trimmed. Trees next to structures/wires with overgrowth, dead limbs, excessive weight, etc. are a danger. Dead limbs fall down. And they don't need a wind to give them a shove, either. A dead limb at a straight drop from a high height can puncture a roof. (And you know you'd be complaining if a limb fell on your child or dog, no?) From a liability/damage perspective, it's prudent to keep trees pruned/topped so they are not top heavy or have weak/dead limbs. This is ideal tree pruning season. And chainsaws/reciprocating saws make noise. And even maintenance is no guarantee when it comes to Mother Nature. We just had a wicked storm blow a large (maintained) tree right on top one of the rentals. A large limb smashed through the picture window where tenant was sitting and ended up laying on their sofa, shooting chunks of glass through the room (fire dept had to cut it out). It happened in the blink of an eye. Thank heavens, no one was hurt. Tree specialsts estimated the weight at several tons. Fire dept said another 10' the other direction, and it would have been disastrous (collapsed building, live wires down and injuries). Just for kicks, let's pretend I didn't maintain that tree. Throw in an extra 1/2 ton of unmaintained dead limb weight and imagine the damage/injury potential. If someone's hurt, now whom do you suppose is going to get sued? Municipalities have codes, especially for shrubs/bushes near driveways and public sidewalks so drivers' vision is not blocked. Nor can the place be allowed to turn into an overgrown jungle. I maintain landscaping (shrubs, etc.) at properties because most tenants won't, or don't know how (yes, there is a proper method, depending on species and age) and I can't risk someone inexperienced getting hurt from a gas or electric saw. We also wash the siding, once a year. Why? Because if we don't all that crud from traffic/weather/birds starts to set in fast and stain the siding and caulking/trim around windows. Those are big $$ items. Not only is it an eyesore, the longer it sits, the harder it is to remove. Ever see siding with a northern exposure that wasn't cleaned? If conditions are right, it can and will grow green mold on it. As far as using your water, where would you have them hook up the pressure washer? Bring a tanker truck with them? (Then you'd be complaining about all the equipment in the driveway?) My tenants pay their own water and I hook up the hose for pressure washer to the outside spigot. It takes about 3 hours, start to finish, to do a small 2-3 bedroom house (presoak it first, scrub some areas, then pressure wash). You probably use more water on laundry day. I will not permit a tenant to take a pressure washer to the siding, risk having them do it from an improper angle and too high pressure and blast siding off the house (yes, that can happen). Not one tenant ever has complained about water use. All are appreciative that the house they live in looks good. None of them look like run down properties. However, if one did complain, I'd probably kick in $10 toward their water bill just to shut them up. And that's generous ($10 is roughly 15%, or 4 1/2 days worth of their average monthly water usage.) Three hours water usage out of 720 hours in a month doesn't amount to squat. That metal-on-metal sound you heard I'm guessing probably involved gutters or flashing, pounding could have been minor roof/shingle repair (driving roofing nails in does generate lots of noise inside the structure, but that's just the way it is.) If gutters aren't cleaned (and this is a critical time of year), leaves and debris will clog them fast. That readily leads to leaks back into the roof, water can seep into rafters/attic insulation, down between walls (where you can't see it but you get to breathe mold spores eventually). During heavy rains water won't go out the downspouts, it simply spills over the gutters in a wall of water, possibly at your front/back door. If the ground is saturated enough, water will seep into the basement, eventually damage the structure and certainly get your personal belongings wet. And if that wall of water hits the ground and freezes, you could easily have a sheet of ice on your porch/sidewalk. So then when you step outside and hit the ice you fall flat on your rear. It saves a lot over the long haul for a landlord to do jobs DIY if possible. If your landlord recruited younger/stronger family members to help, more power to them. Two goof-ups: lack of notice (perhaps family/workers recruited were instructed to give 24 hrs. since your landlord is out of town, and it was an oversight on their part.) And they should have been more careful about the back door area, definately. (I always make sure doors and windows are sealed tight pre-pressure wash, and check after I'm done.) Realistically, on the whole, the only thing your landlord is guilty of is trying to maintain their property and structure, which does benefit you. So pick your battle carefully and weigh everything: a couple days of noise ~ or~ leaky roofs, overflowing gutters, mucked up mildewed siding, mold, seepage, personal property damage, dangerous conditions, etc. The day one of my tenants pays the property taxes, insurance premiums, HVAC repairs, painters, plumbers, electricians, etc. etc. etc. is the day they get to dictate when/how upkeep and repairs are done. I have a life and schedule to work around too, as does any professional or volunteer help I have. If you know they're doing work, and they'll be there for awhile, pack up your child and dog and take them to grandma's for a nap or the park for a walk if it bothers you so badly. And just a tip: if I EVER had a tenant request that I or any workers exit the premises when doing maintenance/repairs (not gonna happen), they wouldn't have to worry about searching for a way out. Tenant just sealed their fate and non-renewed their lease (I just wouldn't let them know it right then). This thread grates on my last nerve. Good grief, be grateful you've got a landlord willing to not let the place rot to pieces around you and look like an eyesore, you'd really have something to complain about then, wouldn't you?

Not a landlord, but I've rented most of my adult life. Honestly, I don't think either request was out of line for a tenant. Here's my take on both. The hair ball in the sink. How long have these women been in the house? Isn't it about a month? It's perfectly possible that the bulk of the hair was deposited by the previous occupants and not the current tenants. If this is a utility sink in the basement, I doubt the young women are washing their hair there. On the other hand, if it's the kitchen sink or the bathroom sink, then maybe they are. But given that the problem could have been caused by the previous occupants, I don't think it's fair to bill them. Now, it might be the kind of thing they could have found out for themselves, if they knew anything about how washers drain into the household plumbing. But it's also the sort of thing that is perfectly fair for tenants to call a landlord about. I agree with PPs that you can go over the cause of the blockage and tell them that this is easily preventable. And that if it happens again, they will pay the plumber's bill. That's fair--now that you both know the cause. The door. I've never checked to see if doors close properly in an apartment I'm renting. Doors closing and latching is just something I think a tenant has a right to expect, just as the stove and fridge should work, electrical outlets should work, water should flow from all faucets. The exception would be if the tenant was informed ahead of time, before signing the lease, that the door did not function as expected. This is a group of three young women living together. Privacy might be an issue. Light and sound control might be an issue. The fact that another room, occupied by a different person, doesn't have a door isn't the same thing--because it is on a floor by itself and the privacy and light and sound issues are not the same. Now, if the door closes and latches, but doesn't lock--that's a separate matter. Pal could have a lock installed--because it's probably a good idea for Pal to have control over the installation instead of letting the young women do it. But the tenant can be informed ahead of time that she will be paying for the lock and the installation. Then she can choose what to do. I rented a two-bedroom with a roommate once and neither bedroom door closed properly--there was some weird kind of latch I'd never seen before and the latches were broken on both doors. As a result, the doors didn't close all the way, but stayed open a few inches, unless you pushed something up against the door to hold it closed. We requested that the doors be made to close before signing the lease, and it was agreed to by the management company, and we kept bugging them until they jury-rigged a solution. One of the bedrooms was right off the living room and it was impossible for one person to be using the living room while the other tried to sleep, because of the light coming in. Tenants have the right to ask for things like carpet to be changed, and landlords have the right to say no. Things like lightbulbs--yes, they can ask, and all Pal has to do is inform them that lightbulbs are the tenants' responsibility. If you want your tenants to unclog toilets, you should provide them with a plunger and make sure they know how to use it. I wouldn't hesitate to call a landlord over that, in theory. However, in reality, it's much faster and easier to plunge the toilet myself, so I do. With blocked drains, I'll try the Zip-it tool, or boiling water and if those don't work, I call the landlord. I don't mind doing simple things to get something to work, but I'm paying rent partly so that I am not responsible for all the maintenance on the place. I'm sorry if this comes across as critical of Pal. I don't mean to be. Based on what I read here, Pal is a responsible person and will be a responsible landlord. But landlords do have to deal with tenants who don't know how things work and who do want repairs made. It's important to know the law for your area and what you are and aren't responsible for fixing and what the time limits are and what the penalties are. If something isn't covered by the law, then you have to determine what you are willing to do. You can always say, "That's your responsibility." Or, if something was clearly the tenant's fault, you can tell them they are responsible for the repair bill. Nearly every lease I've ever signed has a clause that tenants are responsible for the damage they cause, even if the landlord fixes it.

Thanks for your comments so far. Yes, we are definitely on heat and not aux heat. We do have 2 thermostats and they are installed correctly. We agree that there's something causing our electric heat to work overtime for some reason. Don't know why yet. We've had the installing company out after install. There's no gas leak and wiring gets inspected by the county tomorrow. We did a large comparison of our daily electric charge from comparing last December and January to this year. So we compared last year's daily electric charge from our electric company and this year's daily charge. We then compared these charges based on the daily temperature so we could compare correctly. The daily electric charges are 50% higher every single day in our comparisons after the furnace was installed. We need to figure out why our heat pump is working overtime.

Things don't quite add up the way you seem to want them to. You admit that you may have used as much as 350 gallons. Soo...

1)They put in 450 gallons
2) You used five months worth of propane. You think that should have been 350 gallons, but all 450 gallons were gone.
3) They refilled the tank with another 425 gallons

Only 100 gallons of propane are in dispute. (The difference between the original 450 gallons that were put in the tank, and the 350 gallons that you think you used.) If 350 gallons of propane is worth $800, then 100 gallons is worth about $225; ok, this is not nothing, but it is nowhere near the $1000 you seem to expect somebody else to pay.

I don't understand how you owe $1800 if $800 is the price of 350 gallons and they only put in 425 gallons. Haven't you already paid for the 450 gallons you bought in July?

I'm going to assume, since it's the only way that makes even a little sense, that the $1800 is for both the July and the recent tank fills combined(?), which means it is for 875 gallons of propane. You owe, at the very least, for 775 of those gallons; the 350 gallons you believe you already used, as well as the 425 gallons they just put in the tank which you are going to use. You owe the vast majority of this bill even if you are right and there was a leak.

Why do you say you are still losing gas? Didn't the gas company fix the leak? If not, then have them fix it right away! Did they offer to compensate you for the 50 gallons they believe might have leaked away? I would expect them at least to cover that. Which then leaves only 50 gallons in dispute.

You should find out who owns and is responsible for the propane tank; landlord or gas company. I don't know but would guess it's the gas company, in which case any dispute you might have over a leaky tank would be with them. If you think there is some problem with an appliance in the house, then you should discuss with the landlord, but unless you smell gas, you probably don't have a leak in the house. But again, you have only 100 gallons of propane usage to dispute. You do owe for at least the 350 gallons you've used PLUS the 425 gallon tank refill which are are currently using.

Sorry, I didnÂt give all the details! Let me try again! Here's the amount of gas FILLED INTO TANK: 450 gal on July 1 (when I moved into the house); 470 gal on Nov 18 (when tank went unexpectedly totally empty). 180 gal on Dec 8 (thatÂs the "regular" delivery that the company scheduled long ago before the emergency delivery in Nov). 240 gal on Jan 2 (thatÂs an "extra" delivery to gauge if the situation improved after the tiny leak was finally repaired on Nov 28 - unfortunately no "improvement").

This makes a total of 1260 gal from July 1-Jan 2 (i.e. 6 months). The gas supplierÂs records show that previous tenants used around 1,100-1,200 gallons PER YEAR. ThatÂs the figure I relied on when I rented the house and used as my budget. That also agrees with internet "gas calculators" I used.

I also tried to calculate according to seasons (based again on figures given by the supplier and other general sources). HereÂs the breakdown: Summer (July, Aug, Sep) 15 weeks x 10gal/wk = 150 gal. Fall (Oct, Nov) 8 wks x 20gal/wk = 160 gal. Winter (Dec, Jan, Feb, Mar) 16 wks x 48gal/wk = 768 gal. Spring (Apr, May, Jun) 13 wks x 15 gal/wk = 195 gal. Total is 1,195 gal, which ties in well with the 1,200 gal figure in the above paragraph. (Of course this is an approximation and the weather each year is important. Incidentally, this past fall and winter - so far - has been less cold than "normal".)

One more figure to mention: gas rep said theyÂd estimate that for the past 25 days (Dec 8-Jan 2), my usage should be 6-7 gal/day. That means when they filled the tank on Jan 2, it should have been 150-175 gal. But they needed to put in 240 gal. Where did the extra 70-90 gals go?!

And where did gas in the summer and fall months go? Based on the above calculations, I reckoned that from July 1- Dec 8 I should have used about 360 gals. But a whopping 920 gals disappeared in that period!! (By the way, the company only gave me 50 gal credit for the "tiny leak". Should they give me MORE CREDIT?)

As for dollar amount, price here in Massachusetts is around $2.45/gal. I paid for the first tank of 450 gal in July Â over $900 (trusting that it should at least last the summer and fall, but that didnÂt happen.) I paid another $500 in December while negotiating with the supplier and landlord, and I am happy to pay a few hundred dollars more this month. But even so, I still owe them plenty because they have provided 1260 gal. (I wonÂt bore everyone with more figures - enough math for one post!)

Does this make sense? Where did I go wrong? What should I do now?!

Ah! More useful info. There's obviously a malfunction somewhere. Your landlord should get someone from the gas company and/or a plumber out there immediately to check the system and fix what's wrong. Once they figure out what's wrong, it will be easier to figure out who should pay to fix the problem. If it's mechanical, it most likely won't be you paying; your landlord likely will eat the cost since, as you stated, he was made aware of the situation all the way through. You can be nice and offer to help with the payment, but it sounds like you've done your part.

Ok, that makes much more sense. Sorry, I don't have much help for you, though, other than to tell you to keep bugging the gas company to figure out what the problem is.

Has the landlord had the furnace serviced/inspected? I would also make sure he does that. You haven't noticed it running non-stop or anything weird like that, have you? I don't know how much gas a badly functioning furnace could use.

It really sounds to me (COMPLETELY unknowledgable, so don't take this as gospel) that there must still be a leak. Make sure the gas company goes over everything with a fine-toothed comb, make sure you understand what's going on. If they eventually find a leak that they missed, my personal opinion is the gas company should be responsible for the lost gas. I doubt the landlord would be held responsible unless it turns out to be something malfunctioning w/ the furnace, so I would think your best bet is to keep after the gas company.

Also, while moving is a pain, you might check into whether you could get out of the lease because of the situation. If everyone (gas company, landlord) agrees that something is wrong, and it is not getting fixed, that might be an option.

Often it's the gas co.

If so - and it's been malfunctioning for some time, and they've been made aware of it ...

... seems to me that they should eat the extra costs.
