I am a first time new construction home buyer. Just completed my 10 month warranty walk through with builder. Frustrated because the drainage issue problem we have with our lot. The builder states that the lack of drainage is the developers problem, not theirs. We have complained for over a year about the standing, stagnant water. I have only mowed my ditch 2 in a year. The water stands year around and sometimes 2 feet deep plus. We are located in coastal NC and I am at a loss for what to do. We are not the only ones in our new neighborhood. I pay HOA's, but it has yet to be turned over to the community. I just don't know how to proceed before getting a lawyer. Any advice on procedures? What is a homeowner to do when the builder and developer fight over responsibility?
