Lots of settling in new framing. What is ok?

We built a house three years ago, and about a year ago the second floor exterior doors started to jam. I measured the roof and floor, and realized that the framing had settled at a central beam, and as a result the back wall is now way out of level.

My contract is calling it "settiling" - how much is acceptable, and how much is too much. I had to remove the weatherstripping from the door, and it is going to rot.
