The rights to a photo belong to the photographer. Who took the photos? Also, the home IS an example of his work, like it or not. If you were not pleased by his work, I hope you left public reviews on many differnt websites detailing your dissatisfaction.

I think it is normal for those in the trades to post pictures of their work on their websites. If you don't like him using photos of your home, have you requested that he remove them? If a customer asked me to remove a photo, I would remove it without argument.

Did the contract address advertising, photos and future references?

The builder can take a photo of your house from public property and publish it. He would need your permission to take photos on your property. I'm not sure what realistic recourse you would have if he did that without your permission. A copyright would apply to the drawings and images used to build the house.
