Apartment Fees

I made a deposit and wrote the application in person, then called in to verify my move in date. When I arrived, I received the only second floor apartment they said was left. It stunk from dog urine and me and my dog could not sleep there. The next day I complained and was given an option for a first floor unit. I've been stuck with this first floor unit for two years, because they said if I wanted to move to a second floor unit, I'd have to pay pet fees, application fees, sec. deposit all over again. Is this right?
Isn't there a way I can switch units, from first floor to second floor, (what I originally was promised) without paying those fees all over again?

Go back and look at your lease. The lease you originally signed should have had the apartment number you were moving into on it already. When you agreed to the first floor, was it in writing? Was it stipulated that it was a temporary thing until your apartment was cleaned? Also, ask the apartment manager why they want you to pay pet fees, applications, and all that all over again. It may be stipulated in your lease that you have to do that if you want to switch apartments. I know the last apartment we lived in had a clause like that where there was a $500 transfer fee to switch apartments in the building. But if your lease also says that you are leasing the other apartment, then they should have to give it to you. Read over your lease (and renewal if you've had to sign one after being there more than a year) and post back.
