no moisture retarder

My hardwood installer recently put 4" maple floors down and didn't use a moisture/vapor retarder between the subfloor and the hardwood planks. They immediately began to cup (1 or 2 weeks later). Since he did not follow manufacturer's instructions, is it his responsibility to rip the floors up and do it right?

Yes he was a fool but then again nothing he would put under your wood would keep it from cupping if you have that much moisture below.

He should not have installed the flooring until your moisture problem was fixed.
